Container chassis — Decisions

On October 21, 2021, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made preliminary determinations of dumping and subsidizing of container chassis from China.

The subject goods are usually classified under the following tariff classification number: 8716.39.30.90.

To a lesser extent, the subject goods may be classified under the following tariff classification numbers:

The above-listed tariff classifications cover both subject and non-subject goods.

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.

Pursuant to section 8 of SIMA, provisional duty is payable on the subject goods that are released from the CBSA during the period commencing October 21, 2021, and ending on the earlier of the day the investigations are terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duty payable is not greater than the estimated margin of dumping. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

Information

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA website.

Evolugen Energy Marketing Inc.

By an application dated 21 October 2021, Evolugen Energy Marketing Inc. (the Applicant) has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export up to 5 000 000 MWh of combined firm and interruptible energy annually, for a period of 10 years. The Applicant, or its affiliates, has an interest in generation or transmission facilities in Canada, within British Columbia, Ontario and Quebec, as set out in the application.

The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

Notice was received by the Canadian International Trade Tribunal on October 21, 2021, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping and subsidizing of container chassis and container chassis frames, whether finished or unfinished, assembled or unassembled, regardless of the number of axles, for the carriage of containers, or other payloads (including self-supporting payloads) for road, marine roll-on/roll-off and/or rail transport, and certain subassemblies of container chassis originating in or exported from the People’s Republic of China (the subject goods).

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2021-005) to determine whether the dumping and subsidizing of the subject goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a Form I – Notice of Participation with the Tribunal, on or before November 5, 2021. Each counsel who intends to represent a party in the inquiry and at the hearing must file a Form II – Notice of Representation and a Form III – Declaration and Undertaking with the Tribunal, on or before November 5, 2021. The forms can be found in English and French on the Tribunal’s website.

On December 7, 2021, the Tribunal will issue a list of participants. Counsel and self-represented parties are required to serve their respective submissions on each other on the dates outlined in the notice on the Tribunal’s website. Public submissions are to be served on counsel and those parties who are not represented by counsel. Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2021-016) on October 22, 2021, with respect to a complaint filed by 1091847 Ontario Ltd. doing business as Aurora Solutions (Aurora) of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. BPM011620) made by Shared Services Canada on behalf of the Department of Foreign Affairs, Trade and Development. The solicitation was for uninterruptible power supplies and power distribution units.

Aurora alleged that there had been irregularities in the procurement process.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act, that its finding made on January 4, 2017, in Inquiry No. NQ-2016-002, is scheduled to expire on January 3, 2022, unless the Tribunal has initiated an expiry review (Expiry No. LE-2021-004).

Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file Form I — Notice of Participation with the Tribunal on or before November 8, 2021. Quality control, testing, inspection and technical representative services

The Canadian International Trade Tribunal has received a complaint (File No. PR-2021-047) from the Laboratory Services Division of the University of Guelph (University of Guelph) of Guelph, Ontario, concerning a procurement (Solicitation No. 39903-200178/E) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Canadian Food Inspection Agency. The solicitation was for the supply of chemical residue testing. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on October 15, 2021, to conduct an inquiry into the complaint.

The University of Guelph alleges that PWGSC did not adhere to the government procurement requirements of the Canadian Free Trade Agreement as it did not properly provide an address for the submission of tenders and the requirements related to the submission of tenders.

Description of critical habitat of Black-tailed Prairie Dog (Cynomys ludovicianus) in Grasslands National Park of Canada

The Black-tailed Prairie Dog (Cynomys ludovicianus) is a diurnal, semi-fossorial, herbivorous, colonial ground squirrel. The Black-tailed Prairie Dog has short legs, long phalanges and claws for digging, yellowish-brown to reddish-brown fur and a relatively long tail with black tip. It is listed on Schedule 1 of the Species at Risk Act. In Canada, the Black-tailed Prairie Dog is restricted to the lower Frenchman River Valley and adjacent areas in southwestern Saskatchewan.

The Recovery Strategy and Action Plan for the Black-tailed Prairie Dog (Cynomys ludovicianus) in Canada identifies critical habitat for the species within Grasslands National Park of Canada.

Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Black-tailed Prairie Dog, identified in the recovery strategy for the species that is included in the Species at Risk Public Registry, and that is located within Grasslands National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
