SPECIAL IMPORT MEASURES ACT

Small power transformers — Decision

On August 27, 2021, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping respecting certain small power transformers from Austria, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), and South Korea.

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the Canadian industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determination of dumping.

Pursuant to section 8 of SIMA, provisional duty is payable on the subject goods that are released from the CBSA during the period commencing August 27, 2021, and ending on the earlier of the day the investigation is terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted. Where the margin of dumping is considered insignificant, the investigation will continue but provisional duty will not be collected.

The amount of provisional duty payable is not greater than the estimated margin of dumping. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

Information

The Statement of Reasons regarding the preliminary determination will be issued within 15 days following the decision and will be available on the CBSA website.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2021-009) on August 24, 2021, with respect to a complaint filed by Inventa Sales & Promotions (Inventa), of Vancouver, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. K1A30-210980/A) by the Department of Public Works and Government Services on behalf of the Department of the Environment. The solicitation was for virtual event management services related to the World Circular Economy Forum 2021.

Inventa alleged irregularities in the procurement process.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was valid.

FINDING

Certain grinding media

Notice is hereby given that, on August 27, 2021, further to the Canadian International Trade Tribunal’s inquiry (Inquiry No. NQ-2021-001), and following the issuance by the President of the Canada Border Services Agency of final determinations dated July 29, 2021, that chrome cast-iron grinding media in spherical (“ball”) or ovoid shape, with a diameter of 12.7 millimetres (½ inch) to and including 76.2 millimetres (3 inches) within tolerances of 5 percent (5%), with an alloy composition of 10 percent or more (≥ 10% of total mass) chromium (“Cr”) content and produced through the casting method, originating in or exported from the Republic of India (the subject goods), have been dumped and subsidized, the Tribunal found, pursuant to subsection 43(1) of the Special Import Measures Act, that the dumping and subsidizing of the subject goods have caused injury to the domestic industry. Furthermore, the Tribunal excluded subject goods imported for use in cement production facilities.

Shipboard miscellaneous equipment — Repair, overhaul, modification and calibration

The Canadian International Trade Tribunal has received a complaint (File No. PR-2021-034) from Marine Recycling Corporation (MRC) of Port Colborne, Ontario, concerning a procurement (Solicitation No. F7044-200238/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation was for the disposal of the former vessel CCGS W.E. Ricker. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on August 12, 2021, to conduct an inquiry into the complaint.

MRC alleges that PWGSC relied on undisclosed criteria in the evaluation of the bid, failed to apply published evaluation criteria and ignored vital information contained in the bid.

Oil country tubular goods

The Canadian International Trade Tribunal hereby gives notice that the President of the Canada Border Services Agency requests (Request No. MP-2021-001) the Tribunal to rule, pursuant to subsection 89(1) of the Special Import Measures Act, on who is the importer in Canada of certain oil country tubular goods (OCTG2) that are subject to the Tribunal’s finding on OCTG2 issued on April 2, 2015, in Inquiry No. NQ-2014-002, and subsequent Order issued on December 30, 2020, in Expiry Review No. RR-2019-006. A copy of the public version of the request for a ruling is available upon request from the Registry, Secretariat to the Canadian International Trade Tribunal, using the contact information indicated below.

Each person or government wishing to participate in these proceedings must file a Form I — Notice of Participation with the Tribunal on or before September 24, 2021. Each counsel who intends to represent a party in these proceedings must file a Form II — Notice of Representation and a Form III — Declaration and Undertaking with the Tribunal on or before September 24, 2021. The forms can be found in English and French on the Tribunal’s website. The forms should all be filed electronically through the Tribunal’s Secure E-filing Service.

Following receipt of Forms I — Notice of Participation, Forms II — Notice of Representation and Forms III — Declaration and Undertaking, the Tribunal will send a letter to counsel and self-represented participants with information on the E-registry Service and the filing of documents.
