EXPIRY OF ORDER
Certain steel goods
The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 30.03(1) of the Canadian International Trade Tribunal Act (CITT Act), that the Order Imposing a Surtax on the Importation of Certain Steel Goods (Surtax Order), made pursuant to subsection 55(1) of the Customs Tariff by Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance, is scheduled to expire (Expiry No. GC-2018-001-NE) on October 24, 2021.
Any domestic producer of goods that are like or directly competitive with certain heavy plate and stainless steel wire (described more fully in Appendix A, which is available on the Tribunal's website) that are subject to safeguard measures enacted in the Surtax Order, or any person or association acting on behalf of any such domestic producer, may, pursuant to subsection 30.04(1) of the CITT Act, file with the Tribunal a written request that an extension order be made under subsection 63(1) of the Customs Tariff because an order continues to be necessary to prevent or remedy serious injury to domestic producers of like or directly competitive goods. The deadline for filing an extension request in respect of the Surtax Order is April 12, 2021, by noon, ET.
An extension request filed with the Tribunal must provide the information required by section 30.05 of the CITT Act and Rule 111 of the Canadian International Trade Tribunal Rules. Requests shall be subject to a limit of 100 pages (including submissions, witness statements and exhibits in support thereof). Only essential documents or excerpts should be filed as exhibits. Subject to the Tribunal's prerogative to request additional information pursuant to subsection 30.06(1) of the CITT Act, the Tribunal will disregard any pages that exceed this limit. Page format directions are provided in Appendix B, which is available on the Tribunal's website.
Requests should be filed electronically with the Tribunal through its Secure E-filing Service. The information is fully encrypted from the sender to the Tribunal.
Requests should be based on public information to the greatest extent possible. In accordance with section 46 of the CITT Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. The person must also submit either a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made. Please see the Tribunal's Confidentiality Guidelines.
Should the Tribunal determine that an extension request is properly documented, it will notify interested parties that it has received the request and that it is properly documented. These parties will be given an opportunity to make representations to the Tribunal concerning the request. The requester will also be given an opportunity to file reply submissions. The Tribunal will commence an inquiry into the extension request if it is satisfied that the information submitted by the requester and any other information examined by the Tribunal discloses a reasonable indication that the Surtax Order continues to be necessary to prevent or remedy serious injury to domestic producers of like or directly competitive goods and that the request is made by or on behalf of domestic producers accounting for a major proportion of domestic production.

EXPIRY REVIEW OF ORDER

Steel grating
The Canadian International Trade Tribunal hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2020-005) of its order made on April 18, 2016, in Expiry Review No. RR-2015-001, continuing its finding made on April 19, 2011, in Inquiry No. NQ-2010-002, concerning the dumping and subsidizing of carbon steel bar grating and alloy steel bar grating consisting of load-bearing pieces and cross pieces, produced as standard grating or heavy-duty grating, in panel form, whether galvanized, painted, coated, clad or plated, originating in or exported from the People's Republic of China (the subject goods).
In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping and subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping and subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and subsidizing are likely to result in injury. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal's decision to initiate an expiry review, that is, no later than August 26, 2021. The Tribunal will issue its order and its statement of reasons no later than February 2, 2022.
Each person or government wishing to participate in this expiry review must file a Form I — Notice of Participation with the Tribunal on or before September 13, 2021. Each counsel who intends to represent a party in the expiry review must file a Form II — Notice of Representation, as well as a Form III — Declaration and Undertaking, with the Tribunal on or before September 13, 2021.
The schedule for this expiry review is available on the Tribunal's website.
The Tribunal will hold a hearing relating to this expiry review, tentatively scheduled for November 2021. Given the current COVID-19 situation, the type of hearing, the place, and the exact date will be communicated at a later date.

Alarm systems, hazard detecting
The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-096) from Visiontec (2008) Ltd. (Visiontec), of Mississauga, Ontario, concerning a procurement (Solicitation No. 21120-203664/A) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Correctional Service of Canada. The solicitation is for two full-body X-ray scanners. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on March 24, 2021, to conduct an inquiry into the complaint.
Visiontec alleges that PWGSC unfairly barred it from submitting a proposal in response to the solicitation on the basis of an alleged appearance of conflict of interest.

Photovoltaic modules and laminates
Notice is hereby given that, on March 25, 2021, pursuant to paragraph 76.03(12)(b) of the Special Import Measures Act, the Canadian International Trade Tribunal continued its finding (Expiry Review No. RR-2020-001) made on July 3, 2015, in Inquiry No. NQ-2014-003, concerning the dumping and subsidizing of photovoltaic modules and laminates consisting of crystalline silicon photovoltaic cells, including laminates shipped or packaged with other components of photovoltaic modules, and thin-film photovoltaic products produced from amorphous silicon (a-Si), cadmium telluride (CdTe), or copper indium gallium selenide (CIGS), originating in or exported from the People's Republic of China, excluding modules, laminates or thin-film products with a power output not exceeding 100 W, and also excluding modules, laminates or thin-film products incorporated into electrical goods where the function of the electrical goods is other than power generation and these electrical goods consume the electricity generated by the photovoltaic product. In accordance with the Tribunal's finding in Inquiry No. NQ-2014-003, the product definition also excludes 195 W monocrystalline photovoltaic modules made of 72 monocrystalline cells, each cell being no more than 5 inches in width and height.

SPECIES AT RISK ACT
Description of critical habitat of the Red-headed Woodpecker in Point Pelee National Park of Canada and Riding Mountain National Park of Canada
The Red-headed Woodpecker (Melanerpes erythrocephalus) is a medium-sized bird easily identified by its distinctive red head, neck, throat and upper breast and is listed on Schedule 1 of the Species at Risk Act. In Canada, the Red-headed Woodpecker's breeding range extends from southern Saskatchewan through southern Manitoba, Ontario, and into southwestern Quebec. This species can be found in open deciduous forests and other sparsely treed habitats.
The Recovery Strategy for the Red-headed Woodpecker (Melanerpes erythrocephalus) in Canada identifies critical habitat for the species in a number of areas, including within Point Pelee National Park of Canada and Riding Mountain National Park of Canada.
Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Red-headed Woodpecker, identified in the recovery strategy for that species that is included in the Species at Risk Public Registry, and that is located within Point Pelee National Park of Canada and Riding Mountain National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
