(E-REGISTRY SERVICE PILOT PROJECT)

Carbon and alloy steel line pipe

The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act, that its finding made on March 29, 2016, in Inquiry No. NQ-2015-002, concerning the dumping and subsidizing of the subject goods, as defined below, is scheduled to expire (Expiry No. LE-2020-004) on March 28, 2021, unless the Tribunal has initiated an expiry review.

The subject goods are defined as follows:

For greater certainty, the product definition includes unfinished line pipe (including pipe that may or may not already be tested, inspected and/or certified to line pipe specifications) originating in the People's Republic of China and imported for use in the production or finishing of line pipe meeting final specifications, including outside diameter, grade, wall thickness, length, end finish or surface finish, and non-prime and secondary pipes (“limited service products”).

In accordance with the Tribunal's finding in Inquiry No. NQ-2015-002, the subject goods also exclude unfinished seamless carbon or alloy steel line pipe in the form of mother tubes having outside diameters of 184, 197, 210, 235, 260, 286, 328, 350, 368, 377, 394, 402, 419, 426, 450, 475, 480, 500, 521, 530, 560, 585 or 610 mm, in wall thicknesses from 9 mm to 110 mm and in lengths ranging from 7.72 m to 15.24 m, not stenciled as meeting any line pipe product specification, but imported for use in the production, and not solely for finishing, of seamless line pipe made to any one or several of API 5L, CSA Z245.1, ISO 3183, ASTM A333, ASTM A335, ASTM A106, ASTM A53 or their equivalents.

Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file the Form I—Notice of participation with the Tribunal on or before February 1, 2021. Each counsel who intends to represent a party in these proceedings must also file the Form II—Notice of representation, as well as the Form III—Declaration and undertaking, with the Tribunal on or before February 1, 2021. The deadline for filing submissions is noon ET on February 8, 2021. If there are opposing views, each party may file a response no later than noon ET on February 18, 2021.

Following receipt of the notices of participation and of representation, and the declarations and undertakings, the Tribunal will send a letter to counsel and parties with information on the E-registry Service and the filing of documents.

The Tribunal will decide by March 5, 2021, on whether an expiry review is warranted. If not warranted, the finding will expire on its scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.

INQUIRY

Animal and fisheries studies; fisheries resources management services

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-073) from SL Ross Environmental Research Limited (SL Ross), of Ottawa, Ontario, concerning a procurement (Solicitation No. F5211-210003) made by the Department of Fisheries and Oceans (DFO). The solicitation was for the provision of scientific and technical advisory services on matters related to environmental incidents, response measures and emerging technologies. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on January 11, 2021, to conduct an inquiry into the complaint.

SL Ross alleges that the DFO improperly evaluated its bid by rendering submitted projects to be duplicative and finding that the information contained in the bid did not satisfy the rated criteria.

INQUIRY

Informatics professional services

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-074) from Camcode Canada ULC (Camcode), of Vancouver, British Columbia, concerning a procurement (Solicitation No. W6381-170008/D) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for a contractor to provide products and services associated with the data remediation and marking of serially managed materiel. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on January 12, 2021, to conduct an inquiry into the complaint.

Camcode alleges that PWGSC improperly conducted the above-noted procurement by failing to follow the rules set out in its tender documentation and then modifying the resulting contract in a manner that circumvented the obligations contained in the trade agreements. Camcode also alleges that the successful bidder did not meet one of the mandatory requirements of the solicitation.

Tailoring services

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-076) from Niagara Consulting Inc. (Niagara), of Warminster, Ontario, concerning a procurement (Solicitation No. W0100-211248/B) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the supply of tailoring and seamstress services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on January 8, 2021, to conduct an inquiry into the complaint.

Niagara alleges that PWGSC improperly conducted the above-noted procurement by making this solicitation a sole-source procurement, as the incumbent was the only potential supplier with the required security clearance and other vendors did not have the ability to obtain the required security clearance before the time of bid closing.
