CANADA ENERGY REGULATOR

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

NRG Power Marketing LLC

By an application dated 27 October 2020, NRG Power Marketing LLC (the Applicant) has applied to the Canada Energy Regulator (the CER), under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act), for authorization to export up to 2 000 000 MW.h of firm energy annually and up to 1 000 000 MW.h of interruptible energy annually, for a period of 10 years.

The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

The CER is dedicated to the safety and well-being of its staff, Indigenous communities, the public, and all those with whom it works closely. For information on how the CER is continuing its regulatory oversight during the COVID-19 pandemic, please refer to the CER COVID-19 response page.

COMMENCEMENT OF INQUIRY (E-REGISTRY SERVICE PILOT PROJECT)

Decorative and other non-structural plywood

Notice was received by the Canadian International Trade Tribunal on October 23, 2020, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations had been made respecting the dumping and subsidizing of decorative and other nonstructural plywood, whether or not surface coated or covered, and veneer core platforms for the production of decorative and other nonstructural plywood, originating in or exported from the People’s Republic of China. Decorative and other non-structural plywood is defined as a flat, multilayered plywood or other veneered panel, consisting of two or more layers or plies of wood veneers and a core, with the face and/or back veneer made of wood. The veneers, along with the core, are glued or otherwise bonded together. Decorative and other non-structural plywood include products that meet the American National Standard for Hardwood and Decorative Plywood, ANSI/HPVA HP-1-2016 (including any revisions to that standard), but exclude

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry (Inquiry No. NQ-2020-002) to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Tribunal on or before November 9, 2020. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 9, 2020.

The Tribunal will hold a hearing relating to this inquiry in 2021. Given the current COVID-19 situation, the type of hearing, the place and the exact date will be communicated at a later date.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. DETERMINATION

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2020-019) on October 26, 2020, with respect to a complaint filed by K’(Prime) Technologies Inc. (KPrime), of Calgary, Alberta, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. E60PV-20WTMD/A) by the Department of Public Works and Government Services (PWGSC). The solicitation was for conveyer X-ray machines and walk-through metal detectors.

KPrime alleged that PWGSC failed to evaluate its bid in accordance with the terms of the solicitation, and that the winning bidder was ineligible to be awarded the contract.

Having examined the evidence presented by the parties and considered the provisions of the applicable trade agreements, the Tribunal determined that the complaint was valid in part.

Shipboard miscellaneous equipment — Repair, overhaul, modification and calibration

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-056) from Canadian Maritime Engineering Ltd. (CME), of Dartmouth, Nova Scotia, concerning a procurement (Solicitation No. F7044-200238/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation was for the dismantling and disposal of the former vessel CCGS W.E. Ricker. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on October 26, 2020, to conduct an inquiry into the complaint.

CME alleges that PWGSC relied on undisclosed criteria in the evaluation of its bid, failed to apply published evaluation criteria and ignored vital information contained in its bid.

Rules Amending the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure

Amendment

1 Section 52 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure footnote 1 is replaced by the following:

Requirements to be followed

52 An application for the resolution of a matter under an alternative dispute resolution process must be made in accordance with the procedural requirements established by the Commission in Broadcasting and Telecom Information Bulletin CRTC 2019-184, dated May 29, 2019.

Coming into Force

2 These Rules come into force on the day on which they are registered.
