DETERMINATION

Engines, turbines, components and accessories

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2017-060) on May 16, 2018, with respect to a complaint filed by Dynamic Engineering Inc., of Vancouver, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W8482-168399/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for repair and overhaul services for turbochargers fitted on the Halifax-class frigate propulsion diesel engines.

Dynamic Engineering Inc. alleged that PWGSC improperly awarded a contract to a competing bidder based on an improper evaluation of the latter's bid, which was allegedly non-compliant with certain mandatory technical criteria of the Request for Proposal.

Having examined the evidence presented by the parties and considered the provisions of the Canadian Free Trade Agreement, the Tribunal determined that the complaint was valid in part.
