Scientific instruments

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2017-022) on December 29, 2017, with respect to a complaint filed by Vaisala Oyj (Vaisala), of Vantaa, Finland, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. K3D33-170264/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of the Environment. The solicitation was for balloon-borne instruments (radiosondes) and automated ground systems for atmospheric testing.

Vaisala alleged that PWGSC improperly awarded the contract to a competing bidder based on an unreasonable, incomplete and inadequate evaluation of its bid against the mandatory and point-rated criteria of the Request for Proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Revised Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

EXPIRY REVIEW OF ORDER

Seamless carbon or alloy steel oil and gas well casing

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review of its order (Expiry Review No. RR-2017-006) made on March 11, 2013, in Expiry Review No. RR-2012-002, continuing, with amendment, its finding made on March 10, 2008, in Inquiry No. NQ-2007-001, concerning the dumping and subsidizing of seamless carbon or alloy steel oil and gas well casing, whether plain end, beveled, threaded or threaded and coupled, heat-treated or non-heat-treated, meeting American Petroleum Institute specification 5CT, with an outside diameter not exceeding 11.75 inches (298.5 mm), in all grades, including proprietary grades, originating in or exported from the People's Republic of China (the subject goods).

In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping and subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping and subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and subsidizing is likely to result in injury. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal's decision to initiate an expiry review, that is, no later than June 18, 2018. The Tribunal will issue its order and its statement of reasons no later than November 26, 2018.

Each person or government wishing to participate in this expiry review must file a notice of participation with the Tribunal on or before July 3, 2018. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before July 3, 2018.

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing September 17, 2018, at 9:30 a.m., to hear evidence and representations by interested parties. If there are no opposing parties, the Tribunal may explore the possibility of holding a file hearing, i.e. a hearing through written submissions only, instead of an oral hearing.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2017-047) from Tundra Technical Solutions Inc. (Tundra), of Toronto, Ontario, concerning a procurement (Solicitation No. T8086-152167/A) by the Department of Public Works and Government Services (PWGSC) on behalf of Transport Canada. The solicitation is for task-based informatics professional services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on January 15, 2018, to conduct an inquiry into the complaint.

Tundra alleges that PWGSC improperly evaluated its proposal by ignoring responsive information therein.
