Notice of revocation of the Immigration Guidelines

Notice is hereby given that on December 5, 2016, the Canadian Human Rights Commission revoked the Immigration Guidelines, which were registered on July 23, 1980, as SI/80-125.

Rationale

The Immigration Guidelines relate to the application of paragraph 40(5)(a) (formerly subsection 32(5)) of the Canadian Human Rights Act; specifically, they define the terms “lawfully present” and “temporarily absent from Canada” with reference to certain provisions of the Immigration Act, 1976. The Immigration Act, 1976 was replaced by the Immigration and Refugee Protection Act (IRPA), S.C. 2001, c. 27. The Guidelines are obsolete and rely on legislative provisions that are no longer in force.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2016-043) on March 20, 2017, with respect to a complaint filed by Hewlett-Packard (Canada) Co. (Hewlett Packard), of Mississauga, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 2B0KB-123816/C) by Shared Services Canada (SSC). The solicitation was for a high-performance computing solution for SSC.

Hewlett Packard alleged that SSC improperly concluded that its bid did not meet the conditions set out in the Request for Proposal and wrongfully rejected its bid.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2016-041) on March 15, 2017, with respect to a complaint filed by The Masha Krupp Translation Group Ltd. (MKTG), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 1000329852) by the Canada Revenue Agency (CRA). The solicitation was for the provision of translation and editing services.

MKTG alleged that the evaluators failed to evaluate the bids in accordance with the evaluation criteria set out in the solicitation and that they failed to apply themselves in evaluating the bids. MKTG also alleged that the CRA refused to disclose the consensus evaluation and the individual evaluators' notes.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid in part.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-065) from D4iS Solutions Inc. (4165047 Canada Inc.) [D4iS], of Gatineau, Quebec, concerning a procurement (Solicitation No. IC401614) by Innovation, Science and Economic Development Canada (ISED). The solicitation is for task-based informatics and professional services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on March 15, 2017, to conduct an inquiry into the complaint.

D4iS alleges that ISED improperly evaluated D4iS's proposal related to a rated criterion.
