Issue: Whether the excise tax levied on gasoline and diesel fuel pursuant to subsection 23(1) of the Excise Tax Act should be based on the volume of products measured at the storage terminal, as determined by the Minister of National Revenue, and, alternatively, whether the excise tax must be adjusted to account for losses in volume prior to delivery.
