SPECIAL IMPORT MEASURES ACT

Certain hot-rolled carbon steel plate and high-strength low-alloy steel plate — Decisions

On June 10, 2015, pursuant to subsection 31(1) of the Special Import Measures Act, the President of the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain hot-rolled carbon steel plate and high-strength low-alloy steel plate originating in or exported from the Republic of India and the Russian Federation.

The goods in question are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Information

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA Web site at www.cbsa.gc.ca/sima or by contacting Robert Wright at 613-954-1643, or by fax at 613-948-4844.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in these investigations, this information should be received by October 27, 2015.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Hot-rolled carbon steel plate and high-strength low-alloy steel plate

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2015-001) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping and subsidizing of the goods subject to this preliminary injury inquiry originating in or exported from the Republic of India and the Russian Federation (the subject goods) have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.

The subject goods in this preliminary injury inquiry are defined as:

Hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths from 24 inches (+/- 610 mm) to 152 inches (+/- 3,860 mm) inclusive, and thicknesses from 0.187 inches (+/- 4.75 mm) up to and including 3.0 inches (76.2 mm) (with all dimensions being plus or minus allowable tolerances contained in the applicable standards), but excluding plate for use in the manufacture of pipe and tube (also known as skelp), plate in coil form, plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), originating in or exported from the Republic of India and the Russian Federation. For greater certainty, the subject goods include steel plate which contains alloys greater than required by recognized industry standards provided that the steel does not meet recognized industry standards for an alloy-grade steel plate.

The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before June 26, 2015. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 26, 2015.

On July 2, 2015, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. The complainant may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on July 21, 2015. Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2014-055) on June 9, 2015, with respect to a complaint filed by Deloitte Inc. (Deloitte), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W8484-14P2KP/B) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for change management services.

Deloitte alleged that its technical proposal was not evaluated in accordance with the requirements set out in the solicitation documents and that PWGSC failed to provide a meaningful debriefing.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement, the Canada-Chile Free Trade Agreement, the Canada-Peru Free Trade Agreement, the Canada-Colombia Free Trade Agreement and the Canada-Panama Free Trade Agreement, the Tribunal determined that the complaint was valid in part.
