CANADIAN INTERNATIONAL TRADE TRIBUNAL

COMMENCEMENT OF INTERIM REVIEW

Liquid dielectric transformers

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 76.01(1) of the Special Import Measures Act (SIMA), it has initiated an interim review (Interim Review No. RD-2013-003) of its finding of injury made on November 20, 2012, in Inquiry No. NQ-2012-001, concerning the dumping of liquid dielectric transformers having a top power handling capacity equal to or exceeding 60 000 kilovolt amperes (60 megavolt amperes), whether assembled or unassembled, complete or incomplete, originating in or exported from the Republic of Korea.

On March 6, 2014, the Tribunal received notice of a new final determination of dumping made by the President of the Canada Border Services Agency (CBSA) pursuant to paragraph 41.1(1)(a) of SIMA in respect of the above-mentioned goods.

This new final determination stemmed from a decision of the Federal Court of Appeal made on December 6, 2013, that set aside the original final determination of dumping made on October 22, 2012, as a result of an application for judicial review, and referred the matter back to the CBSA for reconsideration.

In light of the new facts and considering the CBSA's new final determination and the reductions in the margin of dumping by exporter and by country, the Tribunal has decided to conduct an interim review of the finding on its own initiative in order to determine if the finding should be either amended, rescinded or continued.

Each person or government wishing to participate in the interim review must file a notice of participation with the Secretary on or before noon on April 7, 2014. Each counsel who intends to represent a party in the interim review must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before noon on April 7, 2014.

On April 10, 2014, the Tribunal will distribute the public information to all parties that have filed a notice of participation and the confidential information to counsel who have filed a declaration and undertaking with the Secretary.

In accordance with paragraph 25(c) of the Canadian International Trade Tribunal Rules, the Tribunal will conduct the interim review by way of written submissions only. Interested parties are invited to file these written submissions with the Tribunal no later than noon on May 7, 2014. In their submissions, parties should address the issue of whether the finding should be amended, rescinded or continued in light of the new margins of dumping.

Each person or government that files a submission in response to the notice of commencement of interim review will be given an opportunity to respond in writing to the representations of other persons or governments. Persons or governments wishing to respond must do so no later than noon on May 21, 2014. All submissions must be filed with the Tribunal in 10 copies.

Submissions should be based exclusively on public information. However, relevant confidential information may be filed, if necessary, along with a comprehensive public summary or public edited version of the confidential information. Confidential submissions will be made available to counsel who have filed the relevant declarations and undertakings.

Parties are required to serve each other. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the List of Participants, which will be distributed to counsel and parties on April 10, 2014. Submissions are to be served in accordance with the directions below:

  1. Submissions that contain information that is confidential to your company/government or your client may be served by electronic means provided you are willing to accept the associated risks.
  2. Submissions that contain third-party confidential information, meaning confidential information belonging to a company/ government that is not your own or that is not represented by you, must be served by courier. Service must be effected so that the said submissions arrive on the stated due dates as set out above.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2013-044) from Valcom Consulting Group Inc. (Valcom), of Ottawa, Ontario, concerning a procurement (Solicitation No. EN578-055605/E) by the Department of Public Works and Government Services (PWGSC). The solicitation is for the provision of task-based informatics professional services (TBIPS). Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision, on March 11, 2014, to conduct an inquiry into the complaint.

Valcom alleges that PWGSC improperly evaluated its proposal.

Notice is hereby given that, on January 21, 2014, the Canadian International Trade Tribunal (the Tribunal) issued a notice of expiry (Expiry No. LE-2013-002) requesting submissions on whether it should initiate an expiry review of its finding made on November 24, 2009, in Inquiry No. NQ-2009-002, concerning the dumping of mattress innerspring units, with or without edgeguards, used in the manufacture of innerspring mattresses, originating in or exported from the People's Republic of China, which is scheduled to expire on November 23, 2014. Upon examination of all arguments and evidence presented by parties that filed submissions, the Tribunal is not satisfied that an expiry review is warranted and, pursuant to subsection 76.03(5) of the Special Import Measures Act, has therefore decided not to initiate an expiry review.
