The Minister of Health, pursuant to subsection 4(1) footnote a of the Agriculture and Agri-Food Administrative Monetary Penalties Act footnote b, makes the annexed Regulations Amending the Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations Respecting the Pest Control Products Act and Regulations (Penalties and Schedules).

Regulations Amending the Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations Respecting the Pest Control Products Act and Regulations (Penalties and Schedules)

Amendment

1 Subsection 14(2) of the Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations Respecting the Pest Control Products Act and Regulations (Penalties and Schedules) footnote 1 is replaced by the following:

(2) Sections 12 and 13 come into force on the day on which section 39 of An Act to amend the Food and Drugs Act, the Hazardous Products Act, the Radiation Emitting Devices Act, the Canadian Environmental Protection Act, 1999, the Pest Control Products Act and the Canada Consumer Product Safety Act and to make related amendments to another Act, chapter 9 of the Statutes of Canada, 2016, comes into force.

Coming into Force

2 These Regulations come into force on the day on which they are registered.

Issues

An error was identified in the coming-into-force provision of the Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations Respecting the Pest Control Products Act and Regulations (Penalties and Schedules) [AMPs].

Objectives

These amendments correct the error identified in subsection 14(2) of the AMPs, which incorrectly referenced the Regulations Amending the Pest Control Products Regulations (Products not Intended for the Canadian Market), which were published on December 26, 2018.

Description and rationale

Subsection 14(2) will be amended to correctly reference section 39 of An Act to amend the Food and Drugs Act, the Hazardous Products Act, the Radiation Emitting Devices Act, the Canadian Environmental Protection Act, 1999, the Pest Control Products Act and the Canada Consumer Product Safety Act and to make related amendments to another Act, chapter 9 of the Statutes of Canada, 2016.

The correction ensures that sections 12 and 13 of the AMPs come into force on the day on which section 39 of An Act to amend the Food and Drugs Act, the Hazardous Products Act, the Radiation Emitting Devices Act, the Canadian Environmental Protection Act, 1999, the Pest Control Products Act and the Canada Consumer Product Safety Act and to make related amendments to another Act, chapter 9 of the Statutes of Canada, 2016, comes into force, which is July 22, 2019.

“One-for-One” Rule and small business lens

The “One-for-One” Rule does not apply to these amendments, as there are no administrative costs or burden to business.

The small business lens does not apply to these amendments, as there are no costs to small businesses.
