Order Fixing the Day on which this Order is made as the Day on which Certain Sections of the Act Come into Force

His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to subsection 228(1) of the Budget Implementation Act, 2017, No. 1, chapter 20 of the Statutes of Canada, 2017, fixes the day on which this Order is made as the day on which sections 196 to 219 and 222 to 227 of that Act come into force.

Coming into Force of Division 10 of the Budget Implementation Act, 2017, No.1

Subsection 228(1) of the Budget Implementation Act, 2017, No. 1, chapter 20 of the Statutes of Canada, 2017, requires that the Governor in Council fix by order the day on which Division 10 comes into force. This Order will bring into force sections 196 to 219 and 222 to 227 [sections 220 and 221 are already in force since they were excluded from the coming-into-force requirement of subsection 228(1)].

Division 10 amended the Judges Act to implement the response of the Government of Canada to the Report of the 2015 Judicial Compensation and Benefits Commission. It provided for the continued statutory indexation of judicial salaries, an increase to the salaries of Federal Court prothonotaries to 80% of that of a Federal Court judge, an annual Incidental Allowance for prothonotaries, and reimbursement of legal costs incurred by prothonotaries during their participation in the compensation review process. It also makes changes to the compensation of certain current and former chief justices to appropriately compensate them for their service. Finally, it makes technical amendments to ensure the correct division of annuities and enforcement of financial support orders, where necessary.

Division 10 also amended the Judges Act to increase the number of judges of the Court of Queen’s Bench of Alberta by 11 judges and the Yukon Supreme Court by one judge. It also increased the number of judicial salaries that may be paid for unallocated “pool positions” under paragraph 24(3)(a) of the Judges Act from 13 to 16 (for appellate court judges), and under paragraph 24(3)(b) from 50 to 62 (for trial court judges).
