FERTILIZERS ACT

Regulations Amending the Fertilizers Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture and Agri-Food, pursuant to subsection 5(1) (see footnote a) of the Fertilizers Act (see footnote b), makes the annexed Regulations Amending the Fertilizers Regulations.

REGULATIONS AMENDING THE FERTILIZERS REGULATIONS

AMENDMENTS

1. (1)Paragraph 3.1(3)(b) of the Fertilizers Regulations (see footnote 1) is replaced by the following:

  • (b) farm fertilizers, if
    • (i) they are mixed fertilizers,
    • (ii) the nutrients contained in them are in a mineral form and are obtained by extraction or by physical or chemical processes, and
    • (iii) they do not contain a pesticide;

(2) Paragraph 3.1(3)(d) of the Regulations is replaced by the following:

  • (d) supplements that consist of seeds that are treated with a fertilizer or a supplement that
    • (i) is exempt from registration, or
    • (ii) is registered, and whose label indicates that it is for use in treating seeds;

(3) Paragraph 3.1(3)(h) of the Regulations is replaced by the following:

  • (h) potting soils that contain a fertilizer or a supplement that
    • (i) is exempt from registration, or
    • (ii) is registered, and whose label indicates that it is for use in potting soils.

2. Section 10 of the Regulations is repealed.

3. (1)Subsections 10.2(1) and (1.1) of the Regulations are repealed.

(2) The portion of subsection 10.2(2) of the Regulations before paragraph (a) is replaced by the following:

(2) A supplement containing viable microorganisms shall be so prepared that

(3) Paragraph 10.2(2)(b) of the Regulations is replaced by the following:

  • (b) the number of viable cells of microbial species are at a level not likely to be generally detrimental or seriously injurious to human, animal or plant health or the environment.

(4) Subsections 10.2(3) to (5) of the Regulations are repealed.

4. Section 10.3 of the Regulations is repealed.

5. Subsections 11(2) and (3) of the Regulations are replaced by the following:

(3) A fertilizer shall not contain plant nutrients that are present at toxic levels if the fertilizer is used at recommended rates.

6. Sections 13 and 14 of the Regulations are repealed.

7. Paragraphs 15(e) to (g) of the Regulations are repealed.

8. Section 17 of the Regulations is repealed.

9. Subsection 21(5) of the Regulations is repealed.

10. Schedule I to the Regulations is repealed.

COMING INTO FORCE

11. These Regulations come into force on April 1, 2013, but if they are registered after that day, they come into force on the day on which they are registered.
