The Treasury Board, on the recommendation of the Minister of Public Safety and Emergency Preparedness, pursuant to subsection 57(1) of the Royal Canadian Mounted Police Pension Continuation Act (see footnote a) and paragraph 7(2)(e) of the Financial Administration Act (see footnote b), hereby makes the annexed Order Amending the Royal Canadian Mounted Police (Dependants) Pension Fund Increase in Benefits Order (Miscellaneous Program).

ORDER AMENDING THE ROYAL CANADIAN MOUNTED POLICE (DEPENDANTS) PENSION FUND INCREASE IN BENEFITS ORDER (MISCELLANEOUS PROGRAM)

AMENDMENT

1. Paragraph 1(b) of the French version of the Royal Canadian Mounted Police (Dependants) Pension Fund Increase in Benefits Order (see footnote 1) is replaced by the following:

  • b) les prestations payables par somme globale au décès du participant sont augmentées de 2 % pour chacun des exercices 2011, 2012 et 2013, au 1er avril de chaque exercice;

Issue and objectives

This Order amends the Royal Canadian Mounted Police (Dependants) Pension Fund Increase in Benefits Order, registered on June 10, 2011, as SOR/2011-122. This amendment will ensure consistency in language between the June 10, 2011, Order and the Royal Canadian Mounted Police Pension Continuation Act (RCMP PCA).

Description and rationale

The language used in the French version of the June 10, 2011, Order is amended for consistency with the RCMP PCA, its enabling legislation. The June 10, 2011, Order provided for benefit increases to recipients of the Royal Canadian Mounted Police (Dependants) Pension Fund, as recommended by the Office of the Chief Actuary. However, the French version of the June 10, 2011, Order uses “montant forfaitaire” as the equivalent of “lump sum” in the English version. In contrast, the RCMP PCA uses “somme globale” as the equivalent of “lump sum.”

The Standing Joint Committee for the Scrutiny of Regulations has directed that the French version of the June 10, 2011, Order should be consistent with the RCMP PCA. Therefore, the language in the French version of the June 10, 2011, Order must be amended to replace the words “montant forfaitaire” with “somme globale.”

This Order Amending the Royal Canadian Mounted Police (Dependents) Pension Fund Increase in Benefits Order (Miscellaneous Program) makes a minor and technical amendment to language. There are no costs associated with this submission.

Consultation

The amendment to the June 10, 2011, Order is being made at the request of the Standing Joint Committee for the Scrutiny of Regulations and in consultation with the Department of Justice Canada.
