CUSTOMS TARIFF
Order Amending the Schedule to the Customs Tariff, 2008-2
P.C. 2008-1928 December 12, 2008
Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to sections 14
(see footnote a) and 82 of the Customs Tariff (see footnote b), hereby makes the annexed Order Amending the Schedule to the Customs Tariff, 2008-2.
ORDER AMENDING THE SCHEDULE TO THE CUSTOMS TARIFF, 2008-2
AMENDMENTS
1. Tariff item Nos. 2921.51.00, 5210.51.00, 5402.19.00, 5402.34.00 and 5407.54.00 in the List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1) are repealed.
2. The List of Tariff Provisions set out in the schedule to the Act is amended as set out in Part 1 of the schedule to this Order.
3. The List of Tariff Provisions set out in the schedule to the English version of the Act is amended as set out in Part 2 of the schedule to this Order.
4. The List of Tariff Provisions set out in the schedule to the Act is amended by adding, in numerical order, the tariff provisions set out in Part 3 of the schedule to this Order.
5. Tariff item Nos. 5210.51.00, 5402.19.00, 5402.34.00 and 5407.54.00 in the List of Intermediate and Final Rates for Tariff Items of the “F” Staging Category set out in the schedule to the Act are repealed.
6. The List of Intermediate and Final Rates for the Tariff Items of the “F” Staging Category set out in the schedule to the Act is amended by adding, in numerical order, the tariff item set out in Part 4 of the schedule to this Order.
COMING INTO FORCE
7. This Order comes into force on the day on which it is registered.
SCHEDULE
PART 1
(Section 2)
AMENDMENTS TO THE LIST OF TARIFF PROVISIONS
1. The Description of Goods of tariff item No. 2934.99.91 is amended by adding a reference to “N4-(2,2-Dimethyl4-[(dihydrogenphosphonoxy)methyl]-3-oxo-5-pyrid[1,4] oxazin-6-yl)-5-fluoro-N2-(3,4,5-trimethyoxyphenyl)-2,4-pyrimidinediamine disodium, for use in the manufacture of pharmaceuticals;” before the reference to “Nucleic acids, nucleosides, nucleotides, and their salts, excluding synthetic nucleotide sequences (oligonucleotides) and their salts;”.
2. The Description of Goods of tariff item No. 4416.00.10 is amended by adding, in alphabetical order, a reference to “Oak barrels to be employed in the fermentation or aging of beverage alcohol;”.
3. The Description of Goods of tariff item No. 5208.22.20 is amended by
(a) adding a semicolon after the reference to “apparel industry”; and
(b) adding, in alphabetical order, a reference to “Solely of cotton, for use in the manufacture of mattress pads”.
4. The Description of Goods of tariff item No. 5402.33.20 is amended by adding a reference to “or sewing threads” after the reference to “knitted fabrics”.
5. The Description of Goods of tariff item No. 5407.20.10 is amended by
(a) adding a semicolon after the reference to “acoustic panels”; and
(b) adding, in alphabetical order, a reference to “Solely of polypropylene strip, for use in the manufacture of machine-tufted carpets”.
6. The Description of Goods of tariff item No. 5803.00.91 is amended by
(a) adding a semicolon after the reference to “onion bags”; and
(b) adding, in alphabetical order, a reference to “Solely of polypropylene yarn in the weft and polypropylene strip in the warp, for use in the manufacture of machine-tufted carpets”.
7. The Description of Goods of tariff item No. 6117.90.10 is amended by adding, in alphabetical order, a reference to “Inserts for use in the manufacture of cycling shorts;”.
8. The Description of Goods of tariff item No. 8419.39.91 is amended by deleting the reference to “Freeze dryers;”.
9. Tariff item No. 8528.49.30 is amended by replacing
(a) in the column “Most-Favoured-Nation Tariff / Initial Rate”, the reference to “Free” with a reference to “6%”;
(b) in the column “Most-Favoured-Nation Tariff / Final Rate”, the reference to “Free (A)” with a reference to “6% (A)”.
(c) in the column “Preferential Tariff / Initial Rate”, the reference to “Free” following the reference to “GPT” with a reference to “3%”; and
(d) in the column “Preferential Tariff / Final Rate”, the reference to “Free (A)” following the reference to “GPT” with a reference to “3% (A)”.

REGULATORY IMPACT
ANALYSIS STATEMENT
(This statement is not part of the Order.)
Issue and objectives
The Order Amending the Schedule to the Customs Tariff, 2008-2 removes the customs duties on a number of manufacturing inputs. It has been a longstanding practice to use Order in Council authority to remove customs duties applicable on imported goods used in the production of other goods to assist Canadian manufacturers. The Order also makes technical changes to two tariff items which were introduced previously.
Description and rationale
The Order removes the customs duties on the following products:
- Certain chemicals for use in the manufacture of rubber compounds;
- Nitenpyram for use in the manufacture of flea control products for dogs and cats;
- N4-(2,2-Dimethyl-4-[(dihydrogenphosphonoxy)methyl]-3oxo-
5-pyrid[1,4]oxazin-6-yl)-5-fluoro-N2-(3,4,5-trimethyoxyphenyl)-2,4-pyrimidinediamine disodium, for use in the manufacture of pharmaceuticals; - Talalay latex for use in the manufacture of bedding products;
- Certain cotton fabric for use in the manufacture of mattress pads;
- Certain plain weave fabric for use in the manufacture of bed comforters;
- Certain nylon filament yarn for use in the manufacture of woven or knitted fabrics;
- Oak barrels to be employed in the fermentation or aging of beverage alcohol;
- Certain bleached or unbleached yarn for use in the manufacture of woven or knitted fabrics or sewing threads;
- Certain single yarn, solely of polypropylene for use in the manufacture of area rugs;
- Certain polypropylene strip for use in the manufacture of machine-tufted carpets;
- Certain woven fabrics, solely of yarns of textured polyester filaments for use as facing or braids in the manufacture of tuxedos;
- Certain printed fabrics for use in the manufacture of sleeping bags;
- Inserts for use in the manufacture of cycling shorts;
- Freeze dryers;
- Certain woven or coated fabrics for use as outer coverings in the manufacture of certain upholstered seats;
- Certain parts for use in the manufacture of subway cars;
- Certain parts for use in the manufacture or repair of light rail vehicles, street cars and subway cars used by urban transit authorities.
The Order adds a missing word in the Description of Goods of tariff item No. 5515.12.30 which was introduced in Order Amending the Schedule to the Customs Tariff, 2008-1 and restores a rate of duty for tariff item No. 8528.49.30 which was introduced with an incorrect rate in the Order Amending the Schedule to the Customs Tariff (Harmonized System Conversion, 2007), No. 2.
This Order is consistent with existing policy and is the most appropriate and timely method to assist Canadian manufacturers in competing more effectively in both the domestic and export markets. Based on current import levels, it is estimated that the annual revenues foregone to the Government as a result of this Order will be approximately $4.9 million.
Consultation
Detailed consultations were undertaken with all interested parties that could be affected by the proposed tariff reductions.
Implementation, enforcement and service standards
The Canada Border Services Agency is responsible for the administration of and compliance with customs and tariff legislation and regulations.
