SPECIAL IMPORT MEASURES ACT

Certain decorative and other non-structural plywood — Decisions

On June 11, 2020, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain decorative and other non-structural plywood from China.

The subject goods are usually imported under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

The Statement of Reasons regarding the decisions will be issued within 15 days following the decisions and will be available on the CBSA website or by contacting the SIMA Registry and Disclosure Unit by telephone at 613‑948‑4605 or by email at simaregistry@cbsa-asfc.gc.ca.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. During the COVID-19 pandemic written submissions must be sent electronically to simaregistry@cbsa-asfc.gc.ca. To be given consideration in these investigations, this information should be received by October 19, 2020.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY
(E-REGISTRY PILOT PROJECT)

Decorative and other non-structural plywood

The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2020-002) to determine whether the evidence discloses a reasonable indication that the dumping and subsidizing of decorative and other non-structural plywood, whether or not surface coated or covered, and veneer core platforms for the production of decorative and other non-structural plywood, originating in or exported from the People’s Republic of China (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA. Decorative and other non-structural plywood is defined as a flat, multilayered plywood or other veneered panel, consisting of two or more layers or plies of wood veneers and a core, with the face and/or back veneer made of wood. The veneers, along with the core are glued or otherwise bonded together. Decorative and other non-structural plywood include products that meet the American National Standard for Hardwood and Decorative Plywood, ANSI/HPVA HP-1-2016 (including any revisions to that standard), but exclude

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before June 24, 2020. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 24, 2020.

Submissions by parties opposed to the complaint must be filed not later than noon, on July 9, 2020. The complainants, as well as supporting parties, may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on July 16, 2020.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File No. PR-2019-053) on June 11, 2020, with respect to a complaint filed by SoftSim Technologies Inc. (SoftSim), of Montréal, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 20-166067) by the Department of Foreign Affairs, Trade and Development. The solicitation was for the provision of trade modernization task-based informatics professional services.

SoftSim alleged that its bid was improperly evaluated and that the terms of the solicitation favoured the successful bidder.

Having examined the evidence presented by the parties and considered the provisions of the Canadian Free Trade Agreement, the Tribunal determined that the complaint was not valid.

Certain whole potatoes

The Canadian International Trade Tribunal hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its order made on September 9, 2015, in Expiry Review No. RR-2014-004, concerning the dumping of certain whole potatoes, excluding seed potatoes, excluding imports during the period from May 1 to July 31, inclusive, of each calendar year, and excluding red potatoes, yellow potatoes and the exotic potato varieties, regardless of packaging, and white and russet potatoes imported in 50-lb. cartons in the following count sizes: 40, 50, 60, 70 and 80, and excluding whole potatoes certified as organic by a recognized certification agency, imported from the United States of America, for use or consumption in the province of British Columbia, is scheduled to expire (Expiry No. LE-2020-002) on September 8, 2020, unless the Tribunal has initiated an expiry review.

The Tribunal’s order in Expiry Review No. RR-2014-004 had continued, without amendment, its order made on September 10, 2010, in Expiry Review No. RR-2009-002, continuing, without amendment, its order made on September 12, 2005, in Expiry Review No. RR-2004-006, continuing, with amendment, its order made on September 13, 2000, in Review No. RR-99-005, continuing, without amendment, its order made on September 14, 1995, in Review No. RR-94-007, continuing, with amendment, its order made on September 14, 1990, in Review No. RR-89-010, which continued, without amendment, (1) the finding of the Antidumping Tribunal made on June 4, 1984, in Inquiry No. ADT-4-84, concerning whole potatoes with netted or russeted skin, excluding seed potatoes, in non-size A, also commonly known as strippers, originating in or exported from the state of Washington, United States of America, for use or consumption in the province of British Columbia, and (2) the finding of the Canadian Import Tribunal made on April 18, 1986, in Inquiry No. CIT-16-85, concerning whole potatoes, originating in or exported from the United States of America, for use or consumption in the province of British Columbia, excluding seed potatoes, and excluding whole potatoes with netted or russeted skin in non-size A, originating in or exported from the state of Washington.

Interested firms, organizations, persons or governments wishing to make submissions on whether an expiry review is warranted must file a notice of participation with the Tribunal on or before June 25, 2020. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 25, 2020. The deadline for filing submissions requesting or opposing the initiation of an expiry review is July 6, 2020, by noon. If there are opposite views, each party may file a reply no later than July 14, 2020, by noon.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-007) from SoftSim Technologies Inc.
