EXPIRY REVIEW OF ORDER

Certain fasteners

The Canadian International Trade Tribunal hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2019-002) of its order made on January 5, 2015, in Expiry Review No. RR-2014-001, continuing, with amendment, its order made on January 6, 2010, in Expiry Review No. RR-2009-001, continuing, with amendment, its findings made on January 7, 2005, in Inquiry No. NQ-2004-005, concerning the dumping of certain carbon steel fasteners originating in or exported from the People’s Republic of China and Chinese Taipei and the subsidizing of such products originating in or exported from the People’s Republic of China (the subject goods). Appendix A lists the products that were excluded from the Tribunal’s previous orders and findings regarding the subject goods.

In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping and subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping and subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and subsidizing are likely to result in injury. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal’s decision to initiate an expiry review, that is, no later than March 26, 2020. The Tribunal will issue its order and its statement of reasons no later than September 2, 2020.

Each person or government wishing to participate in this expiry review must file a notice of participation with the Tribunal on or before April 14, 2020. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before April 14, 2020.

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal’s Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on June 22, 2020, at 9:30 a.m., to hear evidence and representations by interested parties. If there are no opposing parties, the Tribunal may explore the possibility of holding a file hearing, i.e. a hearing through written submissions only, instead of an oral hearing.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

Architectural and engineering design services

The Canadian International Trade Tribunal has received a complaint (File No. PR-2019-042) from Cibinel Architecture Ltd. (Cibinel), of Winnipeg, Manitoba, concerning a request for proposal (Solicitation No. M5000-19-5596/A) by the Royal Canadian Mounted Police (RCMP). The solicitation is for architectural and engineering design services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on October 25, 2019, to conduct an inquiry into the complaint.

Cibinel alleges the RCMP failed to evaluate its bid in accordance with the terms of the solicitation.

Hot-rolled carbon steel plate and high-strength low-alloy steel plate

Notice is hereby given that, on October 31, 2019, the Canadian International Trade Tribunal continued its order (Expiry Review No. RR-2018-007) made on January 7, 2014, in Expiry Review No. RR-2013-002, in respect of the dumping of hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths in widths from 24 in. (+/−610 mm) to 152 in. (+/−3,860 mm) inclusive and in thicknesses from 0.187 in. (+/−4.75 mm) to 4 in. (+/−101.6 mm) inclusive, originating in or exported from the Republic of Bulgaria, the Czech Republic and Romania, excluding plate produced to American Society for Testing and Materials (ASTM) specifications A515 and A516M/A516 Grade 70 in thicknesses greater than 3.125 in. (+/−79.3 mm), universal mill plate, plate for use in the manufacture of pipe and plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate).
