Whether the goods in issue are properly classified under tariff item No. 1901.90.54 as food preparations of goods of headings 04.01 to 04.04, not containing cocoa or containing less than 5% by weight of cocoa calculated on a totally defatted basis, not elsewhere specified or included, and other food preparations of headings 04.01 to 04.04 containing 50% or more on a dry weight basis of milk solids, not put up for retail sale, over access commitment, as determined by the President of the Canada Border Services Agency, or should be classified under tariff item No. 2106.90.95 as other preparations containing, in the dry state, over 10% by weight of milk solids but less than 50% by weight of dairy content, as claimed by Skotidakis Goat Farm.

Description of critical habitat of the Porsild’s Bryum in Quttinirpaaq National Park of Canada

The Porsild’s Bryum (Haplodontium macrocarpum) is a small moss listed on Schedule 1 of the Species at Risk Act. In Canada, the Porsild’s Bryum is typically found throughout northern latitudes and is associated with western mountain ranges.

The Recovery Strategy for Porsild’s Bryum (Haplodontium macrocarpum) in Canada, available at https://www.registrelep-sararegistry.gc.ca/document/default_e.cfm? documentID=1262, identifies critical habitat for this species within Quttinirpaaq National Park of Canada.

Notice is hereby given, pursuant to subsection 58(2) of the Species at Risk Act, that 90 days after the date of publication of this notice, subsection 58(1) of the Act will apply to the critical habitat of the Porsild’s Bryum as identified in the recovery strategy for this species that is included in the Species at Risk Public Registry, and that is located within Quttinirpaaq National Park of Canada, the boundaries of which are described in Schedule 1 to the Canada National Parks Act.
