Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2015-033) on December 29, 2015, with respect to a complaint filed by Neopost Canada Limited (Neopost), of Markham, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. CRA-1000325893) by the Canada Revenue Agency. The solicitation was for the supply of postage meters.
Neopost alleged that its bid was improperly declared non-compliant.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement, the Canada-Chile Free Trade Agreement, the Canada-Peru Free Trade Agreement, the Canada-Colombia Free Trade Agreement, the Canada-Panama Free Trade Agreement, the Canada-Honduras Free Trade Agreement and the Canada-Korea Free Trade Agreement, the Tribunal determined that the complaint was not valid.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2015-047) from Madsen Power Systems Inc. (Madsen), of Mount Pearl, Newfoundland and Labrador, concerning a procurement (Solicitation No. F7049-150105/A) by the Department of Public Works and Government Services (PWGSC) on behalf of Fisheries and Oceans Canada. The solicitation is for the provision of marine diesel generators. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on December 18, 2015, to conduct an inquiry into the complaint.
Madsen alleges that PWGSC improperly evaluated its bid by introducing undisclosed evaluation criteria or by failing to evaluate it in accordance with the terms of the solicitation.

(Dominion Diving), of Dartmouth, Nova Scotia, concerning a procurement (Solicitation No. W3554-166143/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for diving services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on December 29, 2015, to conduct an inquiry into the complaint.
Dominion Diving alleges that PWGSC awarded the contract to an unqualified bidder.

ISSUANCE OF TRIBUNAL'S OPINION

Notice is hereby given that, on December 22, 2015, the Canadian International Trade Tribunal (the Tribunal) issued its opinion (Public Interest Inquiry No. PB-2014-001) and supporting reasons concerning the rate of duty resulting from the finding made by the Tribunal on January 9, 2015, in Inquiry No. NQ-2014-001, respecting concrete reinforcing bar originating in or exported from the People's Republic of China, the Republic of Korea and the Republic of Turkey.
In accordance with paragraph 45(4)(a) of the Special Import Measures Act, the Tribunal will not provide a report to the Minister of Finance because it is of the opinion that the public interest does not warrant a reduction or elimination of the anti-dumping and countervailing duties resulting from the above-mentioned finding.

Application for an order
Notice is hereby given that on December 14, 2015, the Competition Tribunal issued an order granting leave to Stargrove Entertainment Inc. (Stargrove) to make an application pursuant to section 76 of the Competition Act, R.S.C. 1985, c. C-34 and dismissing Stargrove's request for leave to make an application pursuant to sections 75 and 77 of the Act. Stargrove's amended application was filed on December 21, 2015, with the undersigned at the Competition Tribunal and related to the alleged conduct of the Respondents.
The particulars of the orders sought are as follows:
- an order prohibiting the Respondents from continuing to engage in the practices that form the basis of the Application;
- an order requiring the Respondents to accept the Applicant as a customer within 15 days of the Tribunal's order, on the same standard trade terms applicable to other applicants to the Canadian Musical Reproduction Rights Agency Ltd.;
- an order expediting the hearing of the Application;
- an order for costs, if the Application is opposed; and
- an order granting such further and other orders as Stargrove may request and the Tribunal deems just.
Notice is hereby given that any motion for leave to intervene in this matter must be filed with the Deputy Registrar on or before February 15, 2016.
