Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2014-047) on May 6, 2015, with respect to a complaint filed by Lanthier Bakery Ltd. (Lanthier), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 21401-140005/A) by the Department of Public Works and Government Services (PWGSC) on behalf of Correctional Service of Canada. The solicitation was for the provision of bread and bakery products.

Lanthier alleged that PWGSC had divided the contract and had awarded Lanthier only a portion of the contract notwithstanding that the terms of the request for a standing offer did not allow PWGSC to accept offers in part.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement, the Canada-Chile Free Trade Agreement, the Canada-Peru Free Trade Agreement, the Canada-Colombia Free Trade Agreement, the Canada-Panama Free Trade Agreement and the Canada-Honduras Free Trade Agreement, the Tribunal determined that the complaint was not valid.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2015-005) from Oproma Inc. (Oproma), of Gatineau, Quebec, concerning a procurement (Solicitation No. EN869-141670/A) by the Department of Public Works and Government Services (PWGSC). The solicitation is for a faceted document migration software and services solution. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on May 1, 2015, to conduct an inquiry into the complaint.

Oproma alleges that PWGSC improperly concluded that its bid did not meet the requirements of the Request for Proposal and used undisclosed criteria in evaluating its bid.
