Interim Order Respecting Flight Deck Occupants

Whereas the annexed Interim Order Respecting Flight Deck Occupants is required to deal with a significant risk to aviation safety and the safety of the public;

And whereas, pursuant to subsection 6.41(1.2) (see footnote a) of the Aeronautics Act (see footnote b), the Minister of Transport has consulted with the persons and organizations that the Minister considers appropriate in the circumstances concerning the annexed Interim Order Respecting Flight Deck Occupants;

Therefore, the Minister of Transport, pursuant to subsection 6.41(1)(see footnote c) of the Aeronautics Act (see footnote d), makes the annexed Interim Order Respecting Flight Deck Occupants.

INTERIM ORDER RESPECTING FLIGHT DECK OCCUPANTS

Terminology — Canadian Aviation Regulations

1. Unless the context requires otherwise, words and expressions used in this Interim Order have the same meaning as in subsection 101.01(1) of the Canadian Aviation Regulations.

Application

2. This Interim Order applies in respect of the operation of an aeroplane under Subpart 5 of Part VII of the Canadian Aviation Regulations in a passenger-carrying air transport service.

Flight deck occupants

3. An air operator must ensure that, if a flight crew member leaves the flight deck during flight time, one flight crew member and one other crew member are present on the flight deck while the first flight crew member is absent.

Conflict

4. If there is a conflict between the Canadian Aviation Regulations and section 3 of this Interim Order, section 3 of this Interim Order prevails to the extent of the conflict.

MARINE LIABILITY ACT

Ship-source Oil Pollution Fund

Pursuant to section 110 (see footnote e) of the Marine Liability Act (the Act) and the Marine Liability Regulations made pursuant to paragraph 110(3)(b) (see footnote f) of the Act, the maximum aggregate liability of the Ship-source Oil Pollution Fund in respect of any particular occurrence during the fiscal year commencing April 1, 2015, will be $165,837,463.

Ship-source Oil Pollution Fund

Pursuant to section 113 (see footnote g) of the Marine Liability Act (the Act) and the Marine Liability Regulations made pursuant to paragraph 113(3)(b) (see footnote h) of the Act, the amount of the levy in respect of payments into the Ship-source Oil Pollution Fund required by subsection 112(2) (see footnote i) of the Act would be 49.74 cents if the levy were to be imposed pursuant to subsection 114(1) (see footnote j) of the Act during the fiscal year commencing April 1, 2015.

MOTOR VEHICLE SAFETY ACT

Technical Standards Document No. 120, Tire Selection and Rims for Motor Vehicles With a GVWR of More Than 4 536 kg — Revision 2

Notice is hereby given, pursuant to section 12 of the Motor Vehicle Safety Act (MVSA) and sections 16 and 17 of the Motor Vehicle Safety Regulations (MVSR), that the Department of Transport has revised Technical Standards Document (TSD) No. 120, Tire Selection and Rims for Motor Vehicles With a GVWR of More Than 4 536 kg. Revision 2 of TSD No. 120 is effective as of the date of publication of this notice. TSD No. 120 reproduces U.S. Federal Motor Vehicle Safety Standard No. 120, Tire selection and rims for motor vehicles with a GVWR of more than 4,536 kilograms (10,000 pounds), and is incorporated by reference in section 120 of Schedule IV of the MVSR.

On November 20, 2013, the Motor Vehicle Tire Safety Regulations were published, which introduced new testing requirements within Canada Motor Vehicle Safety Standard (CMVSS) 139, New Radial Ply Tires for Motor Vehicles With a GVWR of 4 536 kg or Less. The intent of CMVSS 139 is to provide more stringent safety compliance standards for passenger car and light-truck tires.

Most passenger cars and light trucks sold in Canada have a gross vehicle weight rating (GVWR) of less than 4 536 kg and can hence use CMVSS 139 compliant tires. However, vehicles having a GVWR over the 4 536 kg threshold would fall under the tire and rim selection rules found in TSD No. 120. Due to their use profiles, it may be desirable in some cases to use CMVSS 139 tires on vehicles having a GVWR of over 4 536 kg. Revision 1 of TSD No. 120 did not specifically allow for such applications. As a result, TSD No. 120 is being updated to allow manufacturers the choice of installing the appropriate tires meeting CMVSS 139. In all cases, the gross axle weight rating requirements of TSD No. 120 S5.1.2 must be met. This revision would be consistent with the U.S. interpretation of the applicability of Federal Motor Vehicle Safety Standard (FMVSS) No. 139 tires to FMVSS No. 120 vehicles.
