EXPLANATORY NOTE

The Canadian Food Inspection Agency Fees Notice (Fees Notice) was made by the Minister of Agriculture and Agri-Food on May 13, 2000, under the authority of section 24 of the Canadian Food Inspection Agency Act.

This amendment removes fees for services that the Canadian Food Inspection Agency (CFIA) will no longer be providing as part of re-designing the seed crop certification program to increase the role of authorized parties to provide seed crop inspection services. However, the CFIA will maintain an oversight and audit role to ensure the effectiveness of the overall program. Therefore, the Fees Notice will retain a fee for the completion of inspections conducted to monitor the performance of the authorized third parties.

Seed crop inspection primarily involves confirming that seed production procedures for maintaining varietal seed purity and seed quality are met. It also helps verify that the seed crop is free from prohibited noxious weeds.

Five percent of pedigreed seed is already inspected through alternative service delivery in Canada, with the remainder carried out by the CFIA. Starting in 2014, most growers of pedigreed seed will obtain crop inspection services for the purposes of seed certification from authorized seed crop inspection service providers.

During the transition to alternative service delivery the CFIA will provide 20%–30% of seed crop inspection. After the transition, the CFIA may, on an exceptional basis only, be required to continue to provide for delivery of seed crop inspections in those cases where an authorized service provider is not available or where it is not possible to use private inspectors. The CFIA will deliver seed crop inspection in those situations where such services are required pursuant to a service agreement with the Canadian Seed Growers' Association.

Seed crop inspection is a significant component of the seed certification system. A number of seed certification activities are already carried out by the private sector, such as the sampling, testing, grading and labeling of certified seed. The CFIA continues to consult and work with key industry stakeholder groups to minimize the impact of this change and ensure a smooth transition in 2014.

This amendment removes seed crop inspection fees as CFIA will no longer provide this service on a routine basis. Table 1 to Part 14 of the Fees Notice contains one remaining fee for oversight inspections of authorized parties conducted by CFIA.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2013-031) on April 2, 2014, with respect to a complaint filed by Legacy Products Corporation (Legacy), of Lachine, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W0100-145012/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the supply, delivery and installation of 23 high-speed precision engine lathes.

Legacy alleged that PWGSC improperly evaluated its proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement, the Canada-Chile Free Trade Agreement, the Canada-Peru Free Trade Agreement, the Canada-Colombia Free Trade Agreement and the Canada-Panama Free Trade Agreement, the Tribunal determined that the complaint was valid in part.

(Tritech), of Langley, British Columbia, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. F1700-130429/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation was for the fabrication and provision of aluminum frame members.

Tritech alleged that PWGSC improperly declared its proposal non-compliant.

Hot-rolled carbon steel plate and high-strength low-alloy steel plate

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its finding made on February 2, 2010, in Inquiry No. NQ-2009-003, concerning the dumping of hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths in widths from 24 inches (610 mm) to 152 inches (3 860 mm) inclusive and in thicknesses from 0.187 inch (4.75 mm) up to and including 3.0 inches (76.0 mm) inclusive (with all dimensions being plus or minus allowable tolerances contained in the applicable standards, e.g. ASTM standards A6/A6M and A20/A20M), originating in or exported from Ukraine, excluding universal mill plate, plate for use in the manufacture of pipe and plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), is scheduled to expire (Expiry No. LE-2014-001) on February 1, 2015. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

The Tribunal's expiry proceeding will be conducted by way of written submissions. Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Secretary on or before April 16, 2014. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before April 16, 2014.

On April 17, 2014, the Tribunal will distribute the list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. Ten copies of all submissions must be served on the Tribunal.

Parties requesting or opposing the initiation of an expiry review of the said finding shall file their written public submissions containing relevant information, opinions and arguments, with the Secretary of the Tribunal, counsel and parties of record, no later than April 24, 2014. Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. Parties wishing to respond to the submissions must do so no later than May 2, 2014.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

The Tribunal will issue a decision on May 21, 2014, on whether an expiry review is warranted. If the Tribunal decides that an expiry review is not warranted, the finding will expire on its scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.
