INQUIRY

Food preparation and serving equipment

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2012-024) from Gear Up Motors (GUM), of Richmond, Ontario, concerning a procurement (Solicitation No. W8486-135176/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the provision of 2 000 hunting knives. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

GUM alleges that PWGSC incorrectly evaluated its proposal and improperly awarded a contract to another bidder.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

NOTICE

Carbon steel pipe nipples and adaptor fittings

On September 11, 2012, the Canadian International Trade Tribunal issued Notice of Expiry No. LE-2012-002 relating to the aforementioned order. Persons or governments requesting or opposing the initiation of an expiry review of this order were requested to file written submissions containing relevant information, opinions and arguments with the Secretary of the Canadian International Trade Tribunal no later than October 1, 2012, and replies by October 15, 2012.

The Canadian International Trade Tribunal received no submissions in support of an expiry review and a continuation of the order. Consequently, no expiry review will be initiated.

Pursuant to the Special Import Measures Act, an order continuing a finding of injury or threat of injury and the associated special protection in the form of anti-dumping duties expires five years from the date of the order, unless an expiry review has been initiated.

In light of the foregoing, the Canadian International Trade Tribunal hereby gives notice that, pursuant to paragraph 76.03(1)(b) of the Special Import Measures Act, the order made by the Canadian International Trade Tribunal on July 15, 2008, in Expiry Review No. RR-2007-003 will expire on July 14, 2013.

DECISION

Carbon and certain alloy steel wire rod from Canada

Notice is hereby given, pursuant to rule 70 of the NAFTA Article 1904 Panel Rules, that the panel established to review the Final Results of Antidumping Duty Administrative Review made by the United States Department of Commerce, International Trade Administration, respecting Carbon and Certain Alloy Steel Wire Rod from Canada, issued its decision on October 25, 2012 (Secretariat File No.: USA-CDA-2008-1904-02).

In the October 25, 2012, decision, the binational panel affirmed the Department of Commerce’s Final Results of Redetermination Pursuant to Remand respecting Carbon and Certain Alloy Steel Wire Rod from Canada.

Explanatory note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part Ⅰ, on January 1, 1994.
