IMMIGRATION AND REFUGEE PROTECTION ACT

Updated Ministerial Instructions

Notice is hereby given, under subsection 87.3(6) of the Immigration and Refugee Protection Act, that the Department of Citizenship and Immigration has established the following Ministerial Instructions that, in the opinion of the Minister, will best support the attainment of the immigration goals established by the Government of Canada.

Overview

These Ministerial Instructions identify immigration applications and requests that are eligible for processing under these instructions.

Instructions are directed to officers and their delegates who are charged with handling and/or reviewing applications for permanent or temporary visas to enter Canada.

Authority for Ministerial Instructions is derived from section 87.3 of the Immigration and Refugee Protection Act (IRPA). The Instructions are being issued to ensure that the processing of applications and requests is conducted in a manner that, in the opinion of the Minister, will best support the attainment of the immigration goals established by the Government of Canada.

These Instructions come into force on July 1, 2011.

These Instructions apply to applications received by the designated Citizenship and Immigration Canada offices on or after July 1, 2011.

All Federal Skilled Worker applications received by the Centralized Intake Office in Sydney, Nova Scotia prior to July 1, 2011 shall continue to be considered for processing having regard to the Ministerial Instructions in place at the time of their receipt.

The Instructions are consistent with IRPA objectives as laid out in section 3, specifically to support the development of a strong and prosperous Canadian economy; to see that families are reunited in Canada; to fulfill Canada’s international legal obligations with respect to refugees and provide assistance to those in need of resettlement; and to respect the federal, bilingual and multicultural character of Canada, including to support and assist the development of minority official languages communities.

The Instructions are compliant with the Canadian Charter of Rights and Freedoms.

The Instructions do not apply to refugees or protected persons or persons making a request on Humanitarian or Compassionate grounds from within Canada.

The Instructions respect all previously established accords and agreements including the Quebec-Canada Accord and all agreements with provinces and territories.

Any categories for which Instructions are not specifically issued shall be processed in the usual manner.

Economic Class applications

All Economic Class applications, with the exception of Federal Skilled Worker, federal Immigrant Investor Program, and federal Entrepreneur Program applications, shall be placed into processing according to existing priorities, including:

  • Quebec economic applicants;
  • Provincial Nominees;
  • Canadian Experience Class;
  • Other federal Business Immigrant applicants (self-employed); and
  • Live-in Caregivers.

Federal Skilled Worker applications

Cap on the number of applications to be processed per year

A maximum of 10,000 new Federal Skilled Worker applications, without an offer of arranged employment, will be considered for processing each year.

Within the 10,000 cap, a maximum of 500 new Federal Skilled Worker applications per National Occupation Classification (NOC) code will be considered for processing each year.

In calculating the caps, applications will be considered in order of the date they are received. Applications received on the same date will be considered for processing having regard to routine office procedures.

For the unique purpose of calculating the caps, the cap year will begin on July 1, 2011 and end on June 30, 2012, unless otherwise indicated in a future Ministerial Instruction. Subsequent years will be calculated from July 1st to June 30th, unless otherwise indicated in a future Ministerial Instruction.

Instructions for processing Federal Skilled Worker applications

Federal Skilled Worker applications (see footnote 1) received by the Centralized Intake Office in Sydney, Nova Scotia on or after July 1, 2011, and that meet either of the following criteria shall be placed into processing:

1. Applications submitted with an Arranged Employment Offer (AEO) consistent with requirements of subsection 82(2) of the Immigration and Refugee Protection Regulations.

or

2. Applications from skilled workers with evidence of experience in the last ten years under one or more (see footnote 2) of the following National Occupation Classification (NOC) codes, not exceeding the identified caps:

  • 0631 Restaurant and Food Service Managers
  • 0811 Primary Production Managers (Except Agriculture)
  • 1122 Professional Occupations in Business Services to Management
  • 1233 Insurance Adjusters and Claims Examiners
  • 2121 Biologists and Related Scientists
  • 2151 Architects
  • 3111 Specialist Physicians
  • 3112 General Practitioners and Family Physicians
  • 3113 Dentists
  • 3131 Pharmacists
  • 3142 Physiotherapists
  • 3152 Registered Nurses
  • 3215 Medical Radiation Technologists
  • 3222 Dental Hygienists & Dental Therapists
  • 3233 Licensed Practical Nurses
  • 4151 Psychologists
  • 4152 Social Workers
  • 6241 Chefs
  • 6242 Cooks

No Humanitarian and Compassionate requests to overcome requirements of Ministerial Instructions

Requests made on the basis of Humanitarian and Compassionate grounds that accompany a Federal Skilled Worker application not identified for processing under Ministerial Instructions will not be processed.

Investor Class applications

Cap on the number of applications to be processed per year

A maximum of 700 new federal Immigrant Investor applications will be considered for processing each year.

In calculating the cap, applications will be considered in order of the date they are received. Applications received on the same date will be considered for processing having regard to routine office procedures.

For the unique purpose of calculating the caps, the cap year will begin on July 1, 2011 and end on June 30, 2012, unless otherwise indicated in a future Ministerial Instruction. Subsequent years will be calculated from July 1st to June 30th, unless otherwise indicated in a future Ministerial Instruction.

Instructions for processing federal investor class applications

Federal Immigrant Investor applications (see footnote 3) received by the Centralized Intake Office in Sydney, Nova Scotia on or after July 1, 2011, not exceeding the identified cap shall be placed into processing.

Federal Entrepreneur Class applications

Temporary moratorium

No new federal Entrepreneur application will be accepted unless it is received by the designated Citizenship and Immigration Canada office prior to July 1, 2011. This temporary moratorium will remain in place until otherwise indicated in a future Ministerial Instruction.

Family Class applications

Family Class applications will be processed in the same manner and with the same priorities as usual.

Humanitarian and Compassionate requests

Requests for Humanitarian and Compassionate consideration made from outside Canada will be processed in the usual manner, except in the case where the request accompanies a Federal Skilled Worker application not identified for processing under Ministerial Instructions as stated above.

Temporary Resident applications

All applications for temporary residence, including Temporary Foreign Workers, Foreign Students and Visitors shall continue to be placed into processing immediately upon receipt.

Retention/Disposition

Applicants to the Federal Skilled Worker Program, the federal Immigrant Investor program or the federal Entrepreneur program whose applications are received by the designated Citizenship and Immigration Canada offices on or after July 1, 2011, and which do not meet the criteria described above shall be informed that their application will not continue for processing and their processing fees shall be returned.

CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-04371 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Department of Transport, Quebec.

 2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of gravel, sand, silt, clay and colloids.

 3. Duration of permit: Permit is valid from September 1, 2011, to April 14, 2012.

3.1. The loading and disposal at sea activities are restricted to the periods listed in paragraph 5. The Permittee may modify the duration of the restriction periods with the written approval of the Department of the Environment.

 4. Loading site(s): Cap-aux-Meules access channel, Quebec, 47°22.47′ N, 61°51.11′ W (NAD83), as described in Figure 4 of the environmental screening report titled “Dragage d’entretien chenal d’accès au port de Cap-aux-Meules, Îles-de-la-Madeleine, mars 2011” by the Department of Transport and approved by the Department of the Environment, submitted in support of the permit application.

 5. Disposal site(s):

  • (a) CM-7B, 47°22.17′ N, 61°49.04′ W (NAD83). The disposal site is located at approximately 2.9 km southeast from the loading site. The disposal activities are restricted to the following periods: from September 16, 2011, to April 14, 2012.
  • (b) PB-8B, 47°22.05′ N, 61°47.75′ W (NAD83). The disposal site is located at approximately 4.5 km southeast from the loading site. The disposal activities are restricted to the following periods: from September 1, 2011, to April 14, 2012.

 6. Method of loading: Dredging will be carried out using a clamshell dredge or a hydraulic shovel.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site via towed scow.

 8. Method of disposal: Disposal will be carried out by bottom dumping; and levelling of the seabed by a steel beam, a scraper blade or a hydraulic shovel.

8.1. Disposal shall take place in accordance with the dredged material disposal plan required by paragraph 14 of this permit.

 9. Total quantity to be disposed of:

  • (a) CM-7B: not to exceed 28 000 m3 scow measure.
  • (b) PB-8B: not to exceed 10 000 m3 scow measure.

10. Fees: The fee prescribed by the Disposal at Sea Permit Fee Regulations shall be paid by the Permittee in accordance with those Regulations.

11. Inspection: By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.1. The Permittee shall ensure that records of all loading and disposal activities are kept on site for the duration of the permit and are available for inspection by any enforcement officer or analyst, for two years following the expiry of the permit.

12. Contractors: The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

12.1. The Permittee shall ensure that all persons involved in the loading, transport or disposal activities authorized by this permit conduct these activities in accordance with the relevant permit conditions.

13. Reporting and notification: The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to the Regional Director, Environmental Protection Operations Division, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, 514-496-6982 (fax), immersion.dpe@ec.gc.ca (email).

13.1. The Permittee must complete the Register of Disposal at Sea Operations as provided by the Department of the Environment. This register must, at all times, be kept aboard any vessel involved with the disposal operations and be accessible to enforcement officers designated under the Canadian Environmental Protection Act, 1999.

13.2. The Permittee must keep a written register of the time of departure of the vessel to the disposal site and advise the Canadian Coast Guard station once per day of the departure times entered in the register. The Permittee must record these communications in the register mentioned in paragraph 13.1.

13.3. The Permittee shall submit a written report to the Minister, as represented by the Regional Director identified in paragraph 13, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: a list of all work completed pursuant to the permit, including the names of the loading and disposal sites used, the quantity of matter disposed of at the disposal site(s), the dates on which disposal activities occurred and the Register of Disposal at Sea Operations.

13.4. At all times, a copy of this permit, documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

14. Special precautions: The disposal of dredging material shall take place in accordance with the dredging material plan for each disposal site, as described in the documents titled “Patron de dispersion au site d’immersion CM-7B pour les travaux de 2011” by the Department of Transport and “Patron de dispersion au site d’immersion PB-8B pour les travaux de 2011” by the Department of Environment, submitted in support of the permit application.

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-06673 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Gulf Shrimp Limited, Baie Verte, Newfoundland and Labrador.

 2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

 3. Duration of permit: Permit is valid from August 23, 2011, to August 22, 2012.

 4. Loading site(s): Baie Verte, Newfoundland and Labrador, at approximately 49°56.70′ N, 56°10.06′ W (NAD83).

 5. Disposal site(s): Baie Verte, within a 250 m radius of 49°58.05′ N, 56°09.65′ W (NAD83), at an approximate depth of 36 m.

 6. Method of loading:

6.1. The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.2. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.3. Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

6.4. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

 8. Method of disposal:

8.1. The Permittee shall ensure that the waste to be disposed of is discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion.

 9. Total quantity to be disposed of: Not to exceed 50 tonnes.

10. Inspection:

10.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11. Contractors:

11.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.2. The Permittee shall ensure that all persons involved in the loading, transport or disposal activities authorized by this permit conduct these activities in accordance with the relevant permit conditions.

 3. Duration of permit: Permit is valid from August 23, 2011, to August 22, 2012.

 4. Loading site(s): La Scie, Newfoundland and Labrador, at approximately 49°57.60′ N, 55°36.20′ W (NAD83).

 5. Disposal site(s): La Scie, within a 250 m radius of 49°58.72′ N, 55°37.00′ W (NAD83), at an approximate depth of 65 m.

 6. Method of loading:

6.1. The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.2. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

 5. Disposal site(s): Salvage, within a 250 m radius of 48°42.50′ N, 53°39.00′ W (NAD83), at an approximate depth of 150 m.

 6. Method of loading:

6.1. The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.2. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

 3. Duration of permit: Permit is valid from August 17, 2011, to August 16, 2012.

 4. Loading site(s): St. Lewis, Newfoundland and Labrador, at approximately 52°22.10′ N, 55°41.00′ W (NAD83).

 5. Disposal site(s): St. Lewis, within a 250 m radius of 52°21.40′ N, 55°41.90′ W (NAD83), at an approximate depth of 37 m.

 6. Method of loading:

NOTICE OF VACANCY

CANADIAN MUSEUM OF CIVILIZATION CORPORATION

Chairperson (part-time position)

The Canadian Museum of Civilization Corporation (the Corporation) was established as a federal Crown corporation on July 1, 1990. As a national institution and member of the Canadian Heritage portfolio, the Corporation is responsible for managing the Canadian Museum of Civilization (CMCC) and its affiliate museum, the Canadian War Museum, as well as the Virtual Museum of New France. The CMCC is home to the Canadian Postal Museum, the Canadian Children’s Museum and an IMAX theatre. One of the Corporation’s most important goals is to foster a greater understanding of and appreciation and respect for human cultural achievements in cultural, social, political and military dimensions. Through its research, artifact collections, exhibitions, programs and Web sites, the Corporation disseminates its knowledge throughout Canada and abroad. The Corporation is accountable for its activities to Parliament through the Minister of Canadian Heritage and Official Languages.

The Corporation is governed by a Board of Trustees composed of a Chairperson, a Vice-Chairperson and nine other trustees. The Board has the overall stewardship of the Corporation and is expected to provide strategic guidance to management and to oversee the activities of the Corporation. It has a duty to act in the best interests of the Corporation and to exercise care and due diligence. The Chairperson is responsible for the proper conduct of the Board meetings in such a way that the Corporation carries out its mandate and objectives effectively, ensures good value for public funds, remains viable and holds management accountable for its performance.

The successful candidate should possess a degree from a recognized university in a relevant field of study or an acceptable combination of education, job-related training and/or experience. The qualified candidate should possess significant experience on a board of directors/trustees, preferably as Chairperson, as well as significant experience at the senior management level within the private or public sector. Experience in the development of strategies, objectives, plans, best business practices and in corporate governance is required. Experience in dealing with the federal government, preferably with senior government officials, would be considered an asset. Experience in fundraising activities would also be considered an asset.

The ideal candidate should possess general knowledge of the legislative framework, mandate and activities of the Corporation. Knowledge of roles and responsibilities of the Chairperson, the Board and the Director of a similar-sized organization is necessary. The selected candidate should possess knowledge of corporate governance principles, strategic planning, monitoring and evaluation of performance. The successful candidate is financially literate and should possess knowledge of the federal government’s expectations with regard to accountability and reporting. Knowledge of the federal government’s policy agenda and how it relates to the Corporation would be considered an asset. Knowledge of the cultural, patrimonial and/or recreational tourism sectors would also be considered an asset.

The position requires superior leadership and management skills to enable the Board to accomplish its work effectively. The selected candidate should be able to lead discussions, foster debate among Board members, facilitate consensus and manage conflicts, should they arise. The ability to anticipate emerging issues and develop strategies to enable the Board to seize opportunities and solve problems is essential. The qualified candidate should possess the ability to develop and maintain effective relationships with the Corporation’s management, the Minister of Canadian Heritage, his office, the Deputy Minister of Canadian Heritage and the Corporation’s key stakeholders and partners. Superior communications skills, both written and oral, are required, as well as the ability to act as a spokesperson in dealing with the government, the media, and the Corporation’s stakeholders and partners, and other organizations.

The selected candidate should possess leadership and be a person of sound judgment and integrity. He or she should also adhere to high ethical standards, have superior interpersonal skills, and demonstrate tact and diplomacy.

Proficiency in both official languages would be preferred.

To be appointed as Chairperson of the Board, a person must be a Canadian citizen. The Board meets five times per year, four times in Gatineau and one additional time in another Canadian city. The successful candidate should expect to commit to the position an average of 20 days annually.
