Notice is hereby given that the Canadian International Trade Tribunal made a decision on February 23, 2009, with respect to an appeal filed by Sigvaris Corporation from decisions of the President of the Canada Border Services Agency dated February 7, 2007, with respect to requests for a further re-determination under subsection 60(4) of the Customs Act.

The appeal, heard on March 6 and 7, 2008, under subsection 67(1) of the Customs Act, was allowed.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2008-049) from ISE Inc. (ISE), of Toronto, Ontario, concerning a procurement (Solicitation No. E60PQ-080001/B) by the Department of Public Works and Government Services (PWGSC) on behalf of various government departments. The solicitation is for the provision of office furniture. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

ISE alleges that PWGSC incorrectly deemed its proposal non-compliant.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2008-053) from Lavanett Inc., of Saint-Laurent, Quebec, concerning a procurement (Solicitation No. 21T30-080003/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Correctional Service of Canada. The solicitation is for the provision of a complete three-unit ironing assembly line for flat linens. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Lavanett Inc. alleges that PWGSC improperly awarded a contract to a bidder.

(Doubletex), of Montréal, Quebec, and a complaint from Jules Gordon Agencies Ltd. (Jules Gordon), of Toronto, Ontario, concerning a procurement (Solicitation No. 47131-093656/A) by the Department of Public Works and Government Services on behalf of the Canada Border Services Agency. The solicitation is for the provision of cargo pants. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaints.

Doubletex and Jules Gordon allege that the technical specifications and testing requirements are too restrictive, thus preventing them from submitting a bid.

Addition of five non-Canadian third-language television services to the lists of eligible satellite services for distribution on a digital basis

The Commission approves a request to add five non-Canadian, third-language television services — Star India Plus, Star Chinese Channel, Channel [V] Taiwan, Star India Gold and Star Chinese Movies 2 — to the lists of eligible satellite services for distribution on a digital basis and amends the lists accordingly. The revised lists are available on the Commission’s Web site at www.crtc.gc.ca, under “Broadcasting Sector.”
