Regulations Amending the Pest Control Products Sales Information Reporting Regulations (Miscellaneous Program)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to subsection 67(1) of the Pest Control Products Act (see footnote a), hereby makes the annexed Regulations Amending the Pest Control Products Sales Information Reporting Regulations (Miscellaneous Program).

REGULATIONS AMENDING THE PEST CONTROL PRODUCTS SALES INFORMATION REPORTING REGULATIONS (MISCELLANEOUS PROGRAM)
  AMENDMENTS
  1. (1) Paragraph 3(b) of the French version of the Pest Control Products Sales Information Reporting Regulations (see footnote 1) is replaced by the following:
b) le cas échéant, les nom, adresse postale et numéro de téléphone de la personne qui l'a rédigé au nom du titulaire;
  (2) Paragraph 3(f) of the French version of the Regulations is replaced by the following:
f) la quantité de produit antiparasitaire vendue, exprimée selon l'unité de mesure indiquée dans la déclaration de la quantité nette figurant sur l'étiquette du produit conformément au Règlement sur les produits antiparasitaires.
  2. Section 8 of the French version of the Regulations is replaced by the following:
Rapport sur demande du ministre 8. Le titulaire fournit au ministre, dans un délai de quinze jours, les renseignements disponibles concernant la vente d'un produit antiparasitaire que celui-ci lui demande pour faire face à une situation présentant un danger pour la santé ou la sécurité humaines ou pour l'environnement, ou pour prendre une décision sous le régime de la Loi.

  3. These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

Description

The Pest Control Products Sales Information Reporting Regulations are administered by the Health Canada Pest Management Regulatory Agency and require registrants of pest control products to report annually on the quantity of their product sold in provinces and territories of Canada. The reported quantity of pest control products sold in Canada for the previous year will be summarized before becoming public information.

The Regulations came into effect on November 15, 2006. The Standing Joint Committee for the Scrutiny of Regulations (SJCSR) reviewed these Regulations and made three recommendations on June 11, 2007, which are the subject of this amendment. In the French version a grammatical error was noted in paragraph 3(b); the word "a" will be removed. Also in the French version under paragraph 3(f) "la déclaration du contenu net" will read "la déclaration de quantité nette" for consistency. Lastly, Section 8 in both English and French versions will be harmonized as the English version states for the "purpose of responding" and the French version indicates that is "necessary to respond".

The purpose of the Miscellaneous Amendments Regulations Program is to streamline the regulatory process as well as to reduce costs. This amendment to the Regulations does not impose new restrictions or burdens on individuals or industry and will have little impact on Canadians.
