CANADA SHIPPING ACT, 2001

Order Repealing the Canada Shipping Act and Fixing July 1, 2007 as the Date of the Coming into Force of Certain Sections of the Canada Shipping Act, 2001

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, Infrastructure and Communities, pursuant to section 332 and subsection 334(1) of the Canada Shipping Act, 2001, assented to on November 1, 2001, being chapter 26 of the Statutes of Canada, 2001, hereby fixes July 1, 2007 as the day on which

(a) the Canada Shipping Act is repealed; and

(b) sections 1 to 270, subsections 271(1) and (3) and sections 272 to 318, 321 and 333 of the Canada Shipping Act, 2001 come into force.

EXPLANATORY NOTE

(This note is not part of the Order.)

This Order fixes July 1, 2007 as the day on which the Canada Shipping Act is repealed. The Order also fixes July 1, 2007 as the day on which the Canada Shipping Act, 2001, including the transitional and consequential amendments, other than subsection 271(2) and section 320, that arise from the enactment of that Act, comes into force.

The Canada Shipping Act, 2001 replaces the Canada Shipping Act with modernized legislation that will promote the safety and economic performance of the commercial marine industry as well as ensure the safety of those who use pleasure craft. The Canada Shipping Act, 2001 has adopted a modern approach by updating its terminology, consolidating substantive requirements and incorporating current practices to make it clearer and easier to understand. Key changes include improvements to provisions to protect and support efficient crews, ensure passenger and vessel safety and protect the environment. A new administrative penalties scheme provides an alternative means for dealing with certain contraventions.
