CUSTOMS TARIFF

Order Amending the Schedule to the Customs Tariff, 2006-2

Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to section 82 of the Customs Tariff (see footnote a), hereby makes the annexed Order Amending the Schedule to the Customs Tariff, 2006-2.

ORDER AMENDING THE SCHEDULE TO THE CUSTOMS TARIFF, 2006-2

AMENDMENTS

1. Tariff item No. 2811.21.00, subheading 5208.11, tariff item Nos. 5208.11.10, 5208.11.20, 5208.11.30, 5208.11.90 and 5402.31.00 in the List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1) are repealed.

2. The List of Tariff Provisions set out in the schedule to the Act is amended as set out in Part 1 of the schedule to this Order.

3. The List of Tariff Provisions set out in the schedule to the Act is amended by adding, in numerical order, the tariff provisions set out in Part 2 of the schedule to this Order.

4. Tariff item Nos. 5208.11.20, 5208.11.30, 5208.11.90 and 5402.31.00 in the List of Intermediate and Final Rates for Tariff Items of the "F" Staging Category set out in the schedule to the Act are repealed.

5. The List of Intermediate and Final Rates for Tariff Items of the "F" Staging Category set out in the schedule to the Act is amended by adding, in numerical order, the tariff item set out in Part 3 of the schedule to this Order.

COMING INTO FORCE

6. This Order comes into force on the day on which it is registered.

AMENDMENTS TO THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 2106.90.10 is amended by adding, in alphabetical order, a reference to "Sour dough flavouring ingredients;".

2. The Description of Goods of tariff item No. 2935.00.91 is amended by

( a ) adding a semicolon after the reference to "poultry feeds"; and

( b ) adding, in alphabetical order, a reference to "For use in the manufacture of veterinary anti-inflammatory medicaments".

3. The Description of Goods of tariff item No. 5402.33.10 is amended by

( a ) adding a semicolon after the reference to "bright finish, for use in the manufacture of woven labels"; and

( b ) adding, in alphabetical order, a reference to "Solely of polyester, measuring per single yarn 150 decitex or more but not exceeding 200 decitex, for use in the manufacture of swimwear fabrics".

4. The Description of Goods of tariff item No. 8705.10.10 is replaced by the following:

---Railway maintenance cranes equipped to travel both by road and rail, with a lifting capacity exceeding 36.3 tonnes but not exceeding 68 tonnes

Note: The benefit of the General Preferential Tariff is withdrawn from goods of this tariff item that originate in the Republic of Korea.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Order.)

Description

The Order Amending the Schedule to the Customs Tariff, 2006-2, removes the tariff on sour dough flavouring ingredients; carbon dioxide in non-refillable cylinders for use in Canadian manufactures; certain sulphonamides for use in the manufacture of veterinary anti-inflammatory medicaments; plain weave cotton fabrics, weighing not more than 100 g/m2; certain synthetic filament yarns for use in the manufacture of swimwear fabrics; self-propelled all-terrain cranes; and, semi-submersible crane vessels, floating cranes, and other heavy lift crane vessels, with a minimum gross lift capacity of 1,200 tonnes.

Alternatives

There is no practical alternative for amending the schedule to the Customs Tariff. It is longstanding practice to use Order in Council authority to reduce or remove customs duties on goods used in the production of other goods. An Order made pursuant to section 82 of the Customs Tariff is the appropriate and timely method to assist Canadian industry in competing more effectively.

Benefits and Costs

Canadian industry using these inputs and machinery will benefit from lower costs. It is estimated that the revenue foregone to the Government as a result of this Order will be $4,078,010.

Consultation

Detailed consultations were undertaken with all interested parties expected to be affected by the proposed amendments. There is no opposition to the proposals.

Compliance and Enforcement

Compliance is not an issue. The Canada Border Services Agency is responsible for the administration of custom and tariff legislation and regulations.
