CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-04297 is approved.

1. Permittee: Department of Public Works and Government Services, Quebec Region.

2. Type of Permit: To load or dispose of dredged material.

3. Term of Permit: Permit is valid from April 1 to April 14, 2006, and from June 16 to November 30, 2006.

4. Loading Site(s): Sainte-Thérèse-de-Gaspé Harbour, 48°24.90' N, 64°23.66' W (NAD83), with the exception of the two exclusion zones described in figure 4297-1 from the Department of the Environment faxed to the Department of Public Works and Government Services on February 7, 2006.

5. Disposal Site(s):

(a) Disposal Site ST-4, 48°23.40' N, 64°23.20' W (NAD83); and

(b) Sainte-Thérèse-de-Gaspé Harbour, 48°24.90' N, 64°23.66' W (NAD83).

6. Route to Disposal Site(s):

(a) Direct navigational route from the loading site to the disposal site. The disposal site is located approximately 3 km south of Sainte-Thérèse-de-Gaspé Harbour; and

(b) Not applicable.

7. Equipment: Grab dredge or hydraulic shovel, towed scow, steel beam or scraper blade.

8. Method of Disposal:

(a) Dredging will be carried out using a grab dredge or a hydraulic shovel, and disposal will be carried out using a towed scow; and

(b) Levelling of the seabed by a steal beam or a scraper blade.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 6 000 m scow measure.

11. Material to Be Disposed of: Dredged material consisting of gravel, sand, silt, clay, or colloids.

12. Requirements and Restrictions:

12.1. The Permittee must communicate in writing with Déguste Mer prior to commencing dredging or disposal at sea operations to determine a mutually agreeable working period that will avoid any alteration of the water quality of the seawater intake situated outside of Sainte-Thérèse-de-Gaspé Harbour attributable to sediments suspended by the dredging operations.

12.2. It is required that the Permittee report in writing to the Regional Director, Environmental Protection Operations Directorate, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, (514) 283-4423 (fax), immersion.dpe@ec.gc.ca (email), at least 48 hours prior to the first disposal operation pursuant to this permit.

12.3. The Permittee shall submit a written report to the Regional Director, whose address appears in paragraph 12.2, within 30 days from the expiry of the permit. This report shall include the Register of Disposal at Sea Operations mentioned in paragraph 12.6 and contain the following information: the quantity and type of material disposed of pursuant to the permit, the dates on which the loading and disposal activities occurred, and the equipment used for disposal operations.

12.4. It is required that the Permittee admit any enforcement officers designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 to any place, ship, aircraft, platform or other structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.5. A copy of this permit must, at all times, be kept aboard any vessel involved with the disposal operations.

12.6. The Permittee must complete the Register of Disposal at Sea Operations as provided by the Department of the Environment. This register must, at all times, be kept aboard any vessel involved with the disposal operations and be accessible to enforcement officers designated under the Canadian Environmental Protection Act, 1999.

12.7. The Permittee must signal the Canadian Coast Guard station at Rivière-au-Renard immediately before leaving the port for disposal operations at the disposal site. The Permittee must record these communications in the register mentioned in the previous paragraph.

12.8. The Permittee shall mark out the disposal site with buoys for the entire duration of disposal operations.

12.9. The loading or disposal at sea referred to under this permit shall not be carried out without written authorization from the Permittee.

12.10. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-06379 is approved.

1. Permittee: J.W. Hiscock Sons Ltd., Brigus, Newfoundland and Labrador.

2. Type of Permit: To load and dispose of fish waste and other organic matter resulting from industrial fish-processing operations.

3. Term of Permit: Permit is valid from April 1, 2006, to March 31, 2007.

4. Loading Site(s): 47°32.30' N, 53°12.40' W, Brigus, Newfoundland and Labrador.

5. Disposal Site(s): 47°32.40' N, 53°11.20' W, at an approximate depth of 75 m.

6. Route to Disposal Site(s): Most direct navigational route from the loading site to the disposal site.

7. Equipment: Vessels, barges or other floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all material to be disposed of during loading and transit to the disposal site.

8. Method of Disposal: The material to be disposed of shall be discharged from the equipment or vessel while steaming within 300 m of the approved disposal site. Disposal will take place in a manner which will promote the greatest degree of dispersion. All vessels will operate at maximum safe speed while discharging material.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 500 tonnes.

11. Waste and Other Matter to Be Disposed of: Fish waste and other organic matter resulting from industrial fish-processing operations.

12. Requirements and Restrictions:

12.1. It is required that the Permittee report, in writing, to Mr. Rick Wadman, Environmental Protection Operations Directorate, Environment Canada, 6 Bruce Street, Mount Pearl, Newfoundland and Labrador A1N 4T3, (709) 772-5097 (fax), rick.wadman@ ec.gc.ca (email), at least 48 hours prior to the start of the first disposal operation to be conducted under this permit.

12.2. A written report shall be submitted to Mr. Rick Wadman, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit and the dates on which the loading and disposal activities occurred.

12.3. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999 to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.4. The loading and transit of material to be disposed of at the disposal site must be conducted in such a manner that no material enters the marine environment. Material spilled at any place other than the permitted disposal site must be retrieved. All waste must be contained on shore while the barge is away from the loading site.

12.5. The material to be disposed of must be covered by netting or other material to prevent access by gulls, except during direct loading or disposal of the material.

12.6. This permit must be displayed in an area of the plant accessible to the public.

12.7. Vessels operating under the authority of this permit must carry and display a radar-reflecting device at all times mounted on the highest practical location.

12.8. The loading or disposal at sea conducted under this permit shall not be carried out without written authorization from the Permittee.

12.9. Material loaded for the purpose of disposal at sea may not be held aboard any vessel for more than 96 hours without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

Notice with respect to selected substances identified as priority for action

Pursuant to paragraphs 71(1)(a) and (b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances listed in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice to provide that information no later than June 22, 2006, at 3 p.m. Eastern Daylight Savings Time.

1. This notice applies to any person who, during the 2005 calendar year, manufactured or imported more than 100 kilograms of a substance described in Schedule 1, whether alone, in a mixture or in a product.

1. The definitions in this section apply in this notice.

"calendar year" means a period of 12 consecutive months commencing on January 1.

"import" includes movement into Canada, including internal company transfers across the Canadian border but does not include transit through Canada.

"manufacture" includes to produce or prepare a substance; also includes the incidental production of a substance at any level of concentration as a result of the manufacturing, processing or other uses of other substances, mixtures, or products.

"transit" means the portion of an international transboundary movement through the territory of a country that is neither the country of origin nor the country of destination of the movement.

EXPLANATORY NOTE

(This note is not part of the notice.)

Substances covered by this notice have been identified, through categorization of the Domestic Substances List (DSL), as hazard to the environment or human health or as representing greatest potential for human exposure; or as substances of emerging concern and international interest. The hazard determination was based upon criteria for "inherently toxic" to humans, or properties of persistence, bioaccumulation and aquatic toxicity (PBiT). A need for action was identified as a result of the properties exhibited by these substances. Preliminary research has indicated that a high percentage of these substances may no longer be in commerce in Canada.

The information required by this notice will be used, along with other data sources, to inform current and future risk assessment and risk management activities conducted under the Canadian Environmental Protection Act, 1999. Information submitted may be used to determine whether substances covered by this notice meet the criteria set out in section 64 of the Act.

This notice is published in the Canada Gazette, Part I, pursuant to paragraphs 71(1)(a) and (b) of the Act. This notice requires the persons to whom it applies to provide certain information on their activities with respect to the substances identified in Schedule 1.

Pursuant to subsection 71(3) of the Act, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice is June 22, 2006, 3 p.m. Eastern Daylight Savings Time.

Compliance with section 71 and this notice is mandatory. Subsection 272(1) of the Act provides that

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

Subsection 272(2) of the Act provides that

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) provides that

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) provides that

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

(d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.
