Notice is hereby given that by an application dated May 31, 2001, New Brunswick Power Corporation ("NB Power") has applied to the National Energy Board ("the Board") under Part III.1 of the National Energy Board Act ("the Act", "NEBA") for a Certificate of Public Convenience and Necessity (CPCN) to construct, operate and maintain a 345 kV International Power Line (IPL) from the Point Lepreau Peninsula through Saint John and Charlotte counties to the international boundary near Woodland, Maine. Bangor Hydro Electric Company is actively seeking state and U.S. federal approvals for a new 345 kV line from Orrington, Maine, to connect with the IPL. NB Power also has filed an election under section 58.23 of NEBA that the provisions of NEBA referred to in section 58.27 thereof and not the laws of New Brunswick apply to the proposed 345 kV line.
The proposed IPL will improve the reliability of electric power supply for the Maritime Provinces and the State of Maine by providing a second synchronous connection to the New England system. It will also significantly reduce transmission losses, while improving market access to the area by providing increased transfer capability.
The Board wishes to obtain the views of interested parties on this application before issuing a CPCN. The directions on procedure that follow explain in detail the procedure that will be used.
1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its office located at 515 King Street, Fredericton, New Brunswick E3B 4X1, Attention: Regulatory Affairs, and provide a copy of the application to any person who requests a copy. 3. Pursuant to subsection 58.16(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant.
4. As part of its consideration of the environmental effects of the proposed facilities, the Board will apply the Canadian Environmental Assessment Act ("CEAA"). The Board will ensure that there is no duplication in requirements under the CEAA and the Board's own regulatory process.
5. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by July 24, 2001.
