Notice with Respect to Methyl Bromide

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing the manner in which to control methyl bromide, any person who, during the 1999 or 2000 calendar year, manufactured, imported, exported, purchased, sold or used more than one kilogram of methyl bromide in bulk, whether alone or in a mixture, and who possesses or who may reasonably be expected to have access to the information described in Schedule 1 to this notice, to provide that information no later than August 15, 2001.

Information Required

1. The definitions in this section apply in this notice.

"calendar year" means a period of 12 consecutive months commencing on January 1st.

"export" means movement out of Canada, including inter-firm company transfers across the Canadian border but does not include transit through Canada.

"import" means movement into Canada, including inter-firm company transfers across the Canadian border but does not include transit through Canada.

"in bulk" means, in respect of a substance, confined only by the permanent structures of a container, or a transport unit, without intermediate containment or intermediate packaging.

"mass balance" means the difference between the sum total of the material manufactured, acquired from Canadian suppliers or imported and the sum total of the material sold in Canada, exported, used internally or used in the manufacturing of products.

"transit" means the portion of an international transboundary movement through the territory of a country that is neither the country of origin nor the country of destination of the movement.

"quarantine application" means the treatment, with methyl bromide, of a commodity, product, facility or means of conveyance where the treatment is intended to prevent the spread of, or to control or eradicate, pests of quarantine significance and is required by the laws of an importing country as a condition of entry or by or under Canadian law.

"pre-shipment application" means the treatment, with methyl bromide, within 21 days prior to export, of a commodity or product that is to be entirely exported to another country, or of a means of conveyance, where such treatment is required by the importing country or in support of Canada's sanitary or phytosanitary export programs.

2. For greater certainty, the following includes, but is not limited to, the known mixtures and trade names containing or used to identify methyl bromide and their Pest Control Products Act (PCPA) registration number and the name of the company holding the registration to assist in the accurate identification of registered pesticide products (as for section 5 and 11):

EXPLANATORY NOTE

(This note is not part of the notice.)

Methyl bromide has been regulated since 1995. Under the Ozone-depleting Substances Regulations, (ODS Regulations), a consumption allowance system had been set up, under which a certain quantity of methyl bromide is allotted to each user who applied methyl bromide as a fumigant between 1991 and 1993. A first reduction of 25 percent of the allowances occurred on January 1, 1998, a second reduction of 50 percent occurred on January 1, 2001. Further reductions will be applied gradually until a complete ban by January 1, 2005 is achieved, as indicated in the Regulations Amending Ozone-depleting Substances Regulations, 1998, published on January 3, 2001, in the Canada Gazette, Part II. The purpose of these amendments is to clarify the Regulations and to reflect Canada's international commitments under the Montreal Protocol on Substances that Deplete the Ozone Layer.

In this context of continued reduction of the quantities available, the information collected will assist Environment Canada to determine the uses of methyl bromide, especially for the quantities used in quarantine and pre-shipment applications, and to assess the need for further control strategies and alternatives.

This notice is published in the Canada Gazette, Part I, pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999 (CEPA, 1999). This notice requires the persons to whom it applies to provide certain information on their activities with respect to methyl bromide.

Pursuant to subsection 71(3) of CEPA, 1999, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice is August 15, 2001.

Compliance with CEPA, 1999 is mandatory. Subsection 272(1) of CEPA, 1999 provides that:

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

...

Subsection 272(2) of CEPA, 1999 provides that:

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of CEPA, 1999 provides that:

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) of CEPA, 1999 provides that:

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

(d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-03274 is approved.

1. Permittee: Fraser River Port Authority, New Westminster, British Columbia.

2. Type of Permit: To load or dispose of dredged material.

3. Term of Permit: Permit is valid from July 12, 2001, to July 11, 2002.

4. Loading Site(s): Various approved sites in the Fraser River Estuary, at approximately 49°12.00' N, 123°08.00' W.

5. Disposal Site(s):

(a) Point Grey Disposal Site: 49°15.40' N, 123°22.10' W, at a depth of not less than 210 m;

(b) Sand Heads Disposal Site: 49°06.00' N, 123°19.50' W, at a depth of not less than 70 m;

(c) PWC Spoil Area 2: 49°07.80' N, 123°14.60' W, at a depth of not less than 18 m;

(d) PWC Spoil Area 3: 49°06.40' N, 123°07.90' W, at a depth of not less than 13 m;

(e) PWC Spoil Area 4: 49°07.80' N, 123°04.00' W, at a depth of not less than 14 m; and

(f) PWC Spoil Area 5: 49°09.40' N, 122°59.70' W, at a depth of not less than 10 m.

The following position-fixing procedures must be followed to ensure disposal at the designated disposal site:

(i) The vessel must call the Marine Communications and Traffic Services (MCTS) Centre on departure from the loading site and inform MCTS that it is heading for a disposal site;
(ii) Upon arrival at the disposal site, and prior to disposal, the vessel must again call MCTS to confirm its position. Disposal can proceed if the vessel is on the disposal site. If the vessel is not within the disposal site boundaries, MCTS will direct it to the site and advise that disposal can proceed; and
(iii) The vessel will inform MCTS when disposal has been completed prior to leaving the disposal site.

6. Route to Disposal Site(s): Direct.

7. Method of Loading and Disposal: Clamshell dredge and scow, cutter suction and hopper dredges, bed-levelling equipment and disposal by bottom dump scow or end dumping.

8. Rate of Disposal: As required by normal operations.

9. Total Quantity to Be Disposed of: Not to exceed 125 000 m³.

10. Material to Be Disposed of: Dredged material consisting of silt, sand, rock, broken concrete and steel piling, and other materials typical of the approved loading site except logs and usable wood.

11. Requirements and Restrictions:

11.1. The Permittee must notify the permit issuing office in writing and receive written approval for each loading site prior to any loading or disposal.

11.2. The Permittee must ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of any restrictions or conditions identified in the permit and of the possible consequences of any violation of these conditions. A copy of the permit and the letter of transmittal must be carried on all towing vessels and loading platforms or equipment involved in disposal at sea activities.

11.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11.4. Contact must be made with the Canadian Coast Guard, Regional Marine Information Centre (RMIC), regarding the issuance of a "Notice to Shipping." 11.5. Any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, shall be permitted to mount an electronic tracking device on any vessel that is engaged in the disposal at sea activities authorized by this permit. The Permittee shall take all reasonable measures to ensure there is no tampering with the tracking device and no interference with its operation. The tracking device shall be removed only by an enforcement officer or by a person with the written consent of an enforcement officer.

11.6. The Permittee must submit to the Regional Director, Environmental Protection Branch, within 30 days of the expiry of the permit, a list of all work completed pursuant to the permit, the nature and quantity of material disposed of and the dates on which the activity occurred.

3. Term of Permit: Permit is valid from July 2, 2001, to March 31, 2002.

4. Loading Site(s): 46°13.81' N, 64°17.86' W (NAD83), Les Aboiteaux (Dupuis Corner) entrance channel, as described in the drawing "Site Plan (April 2001)" submitted in support of the permit application.

5. Disposal Site(s): Site A: 46°13.98' N, 64°18.56' W (NAD83) to 46°14.00' N, 64°18.14' W (NAD83), as described by the drawing "Disposal Sites 2001 (April 2001)" submitted in support of the permit application.

Site B: 46°14.05' N, 64°17.75' W (NAD83), as described by the drawing "Disposal Sites 2001 (April 2001)" submitted in support of the permit application.

6. Route to Disposal Site(s): Via pipeline.

7. Equipment: Suction dredge and pipeline.

8. Method of Disposal: Via pipeline.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 20 000 m³ place measure.

11. Material to Be Disposed of: Dredged material consisting primarily of sand.

12. Requirements and Restrictions:

12.1. It is required that the Permittee notify in writing, by facsimile or electronic mail, Mr. Clark Wiseman, Environmental Protection Branch, Department of the Environment, Atlantic Region, Queen Square, 16th Floor, 45 Alderney Drive, Dartmouth, Nova Scotia B2Y 2N6, (902) 426-7924 (Facsimile), clark. wiseman@ec.gc.ca (Electronic mail), at least 48 hours prior to each occasion that dredging equipment is mobilized to the loading site. The notification shall include the equipment to be used, contractor, contact for the contractor, and expected period of dredging.

12.2. A written report shall be submitted to Mr. Clark Wiseman, identified in paragraph 12.1., within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity and type of material disposed of pursuant to the permit, the equipment used and the dates on which the loading and disposal activities occurred.

12.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

12.4. Procedures to accurately measure or estimate quantities of dredged material disposed of at each disposal site shall be submitted to Mr. Victor Li, Environmental Protection Branch, Department of the Environment. The procedures shall be approved by the Department of the Environment prior the commencement of the first dredging operation to be conducted under this permit.

12.5. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, to any place, ship, aircraft, platform or anthropogenic structure directly related to the loading or ocean dumping referred to under this permit, at any reasonable time throughout the duration of this permit.

12.6. The Permittee shall notify in writing Mr. Marc Godin, Department of Fisheries and Oceans, P.O. Box 3420, Station Main, Tracadie-Sheila, New Brunswick E1X 1G5, (506) 395-7713 (Facsimile), at least 48 hours prior to the commencement of the first dredging operation.

12.7. The Permittee shall implement the mitigative measures identified in Part D of "Environmental Screening for Les Aboiteaux (Dupuis Corner) Channel Entrance Dredging (May 1998)" submitted in support of the permit application. Modifications to the mitigative measures shall be made only with the written approval of Environmental Protection Branch, Department of the Environment.

12.8. A copy of this permit and documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are underway.

12.9. The dredging and disposal at sea authorized by this permit shall be carried out by the Permittee or by any person with written approval from the Permittee. Within 24 hours of authorizing approval to another person to conduct the dredging and disposal authorized by this permit, the Permittee shall submit by facsimile a copy of the written approval to Mr. Clark Wiseman, identified in paragraph 12.1.

CANADA MARINE ACT

Vancouver Port Authority — Supplementary Letters Patent

BY THE MINISTER OF TRANSPORT

WHEREAS Letters Patent were issued by the Minister of Transport for the Vancouver Port Authority (the "Authority") under the authority of the Canada Marine Act (the "Act"), effective March 1, 1999;

WHEREAS Schedule B of the Letters Patent describes the federal real property managed by the Authority;

WHEREAS the Authority pursuant to subparagraph 46(1)(b)(i) of the Act wishes to exchange with 366466 B.C. Ltd. the federal real property described in section 1 below for the real property described in section 2 below;

AND WHEREAS the Board of Directors of the Authority has requested the Minister of Transport to issue Supplementary Letters Patent to reflect this exchange of lands;

NOW THEREFORE under the authority of section 9 of the Canada Marine Act, the Letters Patent are amended as follows:

1. Paragraph 1 of Schedule B to the Letters Patent is amended by adding the following after subsection (b):

(c) all and singular that certain parcel or tract of land and land covered by water comprising a portion of the bed and foreshore of Burrard Inlet fronting District Lot 274, lying in the City of North Vancouver, New Westminster Land District in the Province of British Columbia, and which may be more particularly described as follows:

Firstly: Commencing at the south-easterly corner of Lot 1 (Reference Plan 1828) of the bed and foreshore of Burrard Inlet lying in front of Lots 1 to 12, Block 176, District Lot 274, Group 1 (Vancouver) LTO; thence 33°42'49", 23.680 metres more or less to a point on the south-easterly boundary of said Lot 1, being also the most westerly south-west corner of Lot B of that portion of the bed and foreshore of Burrard Inlet lying in front of Blocks 175 and 176, District Lot 274, Plan 11879 (Vancouver) LTO; thence 123°42'47", 101.521 metres to a point on the south-westerly boundary of said Lot B; thence 213°42'49", 23.680 metres; thence 303°42'47", 101.521 metres to the point of commencement.

2. Paragraph 2 of Schedule B to the Letters Patent is amended by deleting the word "and:" after PID Number 023-760-117 and by adding the following after the table containing the description of the Instrument "Provincial Order in Council 839 approved and ordered April 2, 1981":

These Supplementary Letters Patent are to be effective on the later of:

(i) the date of registration in the New Westminster Land Title Office of the transfer documents evidencing the transfer of the federal real property from Her Majesty the Queen in right of Canada to 366466 B.C. Ltd.; and
(ii) the date of registration in the New Westminster Land Title Office of the transfer documents evidencing the transfer of the real property from 366466 B.C. Ltd. to Her Majesty the Queen in right of Canada.

If both transfers identified in (i) and (ii) above are registered on the same date, these Supplementary Letters Patent are to be effective on the date of registration.
